The thing is the reporter he's verbally sparring with has just pointed out that it is NOT lawful unless you take the shaky legal point of view that George W. Bush's will supercedes the plain language of the Constitution.<BR/><BR/>The interesting point is that when and if Hayden ever does come in front of a war crimes tribunal his defense will wilt when the prosecution points to Lt. Ehren Watada, several pay grades below Hayden but still with enough sense to recognize the truth.
