ENOUGH IS ENOUGH --DOWN WITH COPS!

My comments are inspired by a story that Jay Diamond had posted on Facebook:
Federal investigators have opened an inquiry into the tragic case of a high school student in Bastrop County, Tex., who suffered severe brain damage and nearly died last fall after a deputy sheriff shocked him with a Taser, a high voltage electronic weapon.
In North Carolina, civil rights lawyers have filed a complaint with the Justice Department, charging the Wake County school system with violating the constitutional rights of minority children by subjecting them to discriminatory arrest practices and brutality by police officers assigned to schools. In one nightmarish case described in the complaint, a disabled 15-year-old was shocked with a Taser three times during an interrogation at school, resulting in punctured lungs. And in New York, civil rights lawyers have sued the city of Syracuse on behalf of two students. One was shocked three times, not for threatening behavior but for lying on the floor and crying, they say, and another was shocked while trying to break up a fight.

Psychopathic cops should be locked up and tried; in those cases resulting in death i.e, "murder", they should be tried and, when found guilty, executed!

I covered the trial of two Houston cops who were charged with having beaten hell out of an Hispanic war hero who got a little rowdy in club. Twenty-three year old Joe Campos Torres [at right], a 23-year-old Vietnam Veteran, was was beaten by several Houston police officers and then taken to jail. The jailer refused to admit him and ordered the cops to hospitalize him. Instead, the cops (whose trial I covered) took him --in the dead of night --to a bridge over Buffalo Bayou where they beat him to a pulp. Just barely alive, he was leveraged over the bridge and dropped into the inky dark waters of buffalo bayou some 15 ft below.He drowned.

I covered the trial after both cops were charged for murder. Both were acquitted! Outrageous! His death sparked protests and the outcome of the trial was met with rioting.

It is apparent to me that "police brutality" has only gotten worse, has spread like a virus, and routinely goes un-investigated, un-punished! It is apparent to me that COPS have gotten even worse, increasingly psychopathic, poorly trained and recruited from among the DREGS OF SOCIETY.

In a civilized society, a police force is expected to uphold the "rule of law"; they are not required or expected to take the law into their own hands. At the very least, rogue and criminal cops must be arrested, arraigned and made to stand trial for felonies to include assault and battery and murder!
My two cents worth: a nation, an empire is finished when it cannot rule itself, when it cannot distinguish between the rule of law and the ABUSE of law!

How Citizens United Subverted the Rights of Real People and Created a Fascist State

I've often written about the detailed and vivid account of A. Hitler's meeting with top German industrialists --Krupp, Thysen, I.G. Farben et al. It was in that meeting that German fascism was made real in terms of an agreement between the Reich and its 'fascist' sponsors, the huge corporations who would benefit from aggression, death and destruction.
The meeting may not have defined the word 'fascism' but it most certainly birthed a Nazi regime in which corporations were given and promised not only privileges but, most importantly, big juicy contracts.

From a lesser known source is another detailed description of the nature of Hitler's fascist partnership with big business:
"From now on, the government in Berlin will allocate large sums to industrialists so that each can establish a secure post-war foundation in foreign countries. Existing financial reserves in foreign countries must be placed at the disposal of the party in order that a strong German empire can be created after defeat. It is almost immediately required," he continued, "that the large factories in Germany establish small technical offices or research bureaus which will be absolutely independent and have no connection with the factory. The bureaus will receive plans and drawings of new weapons, as well as document which they will need to continue their research. These special offices are to be established in large cities where security is better, although some might be formed in small villages nears sources of hydroelectric power, where these party member can pretend to be studying the development of water resources for benefit of Allied investigators."

Some have said that the 'brand' of fascism now emerging in Western democracies, the U.S. in particular, is a completely new phenomenon. I disagree! The odious 'Citizen-United' decision, in which SCOTUS decreed that corporations were 'persons', is an open and odious declaration that a corporation may utilize its wealth, riches and privileges to enslave a population of 'real people' whose humanity is as self-evident as were the principles Thomas Jefferson had declared of 'real' persons in our own 'Declaration of Independence":
We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed...
Earlier, John Adams had written of the same concepts in somewhat different words:
All men are born free and equal, and have certain natural, essential, and unalienable rights; among which may be reckoned the right of enjoying and defending their lives and liberties; that of acquiring, possessing, and protecting property; in fine, that of seeking and obtaining their safety and happiness.
Now, of course, we know that these rights extend to women as well. Surely --even our crooked court must understand that. Even so, the Roberts court cannot be trusted to defend the rights of men or women, or, indeed, the rights of REAL persons of any color, creed or sex. Our court cannot be trusted to uphold the law when it was respected. Nor does it recognize an even older and more venerable position: that governments derive their power, and rights of power from the peole who are ---alone --sovereign!

A Case for Ending the Current Method by Which Presidents are 'Selected'

The office of President is connected to the electorate 'metaphorically' but not in fact. The very method by which the President is elected is complicated by party machines, primaries, state election procedures and most notably an antiquated and completely useless 'Electoral College'.

As long as there is an 'electoral college', 'third parties' are reduced to playing 'spoiler'; 'states' are given powers they should not have. The 'President' is supposed to represent ALL the people but he/she is, in fact, elected by states and/or state party machines. And those, in turn, are but pawns of big contributors, organized lobbies and special interests.

The only viable alternative is to end the primaries; replace them with a single national popular election defined and decided by an 'instant runoff'. A benefit of this is that free of 'party' machinations, candidates must run on issues. The 'President' of the United States (in theory, at least) must represent all of the people of the United States. A 'direct election' can make a truth of this fiction.

Then --why is the 'President' elected by 'states'?
The following criteria are listed in [an] LWV study:
  • Ensure majority rule. Most major political races currently can be won with only a plurality.
  • Encourage minority representation, where minority is defined by either party or cultural
  • affiliation.
  • Encourage fair gender representation.
  • Produce fair and accurate representation of diverse political views in legislatures.
  • Increase voter participation.
  • Encourage geographical representation.
  • Encourage “sincere” voting, as opposed to “strategic” voting.
  • Maximize effective votes/minimize “wasted” votes.
  • Provide a reasonable range of voter choice.
  • Prevent fraud and political manipulation.
  • Encourage competitive elections

There are many ways to arrive at the 'people's choice following a national popular election. The Borda count, for example, is a single-winner election method. Voters are given a list of candidates representing every party fielding a candidate. The voter simply RANKS the candidates in the order of their preference. Their favorite, for example, is 'number one', etc.

Thus the Borda count determines a winner by giving each candidate the number of points which correspond to his/her rank as 'marked' by each voter. Nothing could be simpler: the winning candidate is the one with the most points.

The Borda count is but one system. There are competing 'range' and/or preference systems. All of them, however, must meet certain criteria if we are to achieve the goals of any new proposal.

Everyone's vote must 'equal' everyone's else's vote, i.,e no system should result in any vote or sub-set of votes having more 'weight' statistically than any other vote. One man (person), one vote must become more than mere slogan. It is possible that it be made a fact!

What does this mean to voters? Simplistically, a vote in rural Arizona must --and can -- carry as much 'weight' as a vote in Houston's very, very posh and elite 'River Oaks'; a vote in Harlem must --and can -- carry the same weight as a vote in Minnesota or a vote in any other place, city, neighborhood or enclave in these United States. The President is --after all --said to be elected by popular vote. But that has not been the case in fact and practice. The biggest offender is the 'Electoral College'. Thanks to the electoral college, the value of individual votes in small states are not worth much.

Another benefit is that party machinations may be, can be minimized. Any party can 'elect' within its rank any candidate it desires. Let the parties do what they want within their ranks --as long as its legal. But --as more parties are sure to spring up --more points of view will be represented. The obvious benefit is that voters are no longer reduced to voting between two shades of gray, between frick or frack, between GOP or GOP-LITE. The people will at last been given a choice. Democracy will have at last come to the United States.

The greatest benefit of all may be that the cost of elections will decline. Candidates must address issues over postures and strategies. Voters will themselves sense that --at last --their vote is actually counting for something, that it is not merely lost amid the electoral college and/or the machinations of increasingly complicated and completely out-of-touch parties, primaries and machines.

Sue TSA Perverts/Airlines/Airports for 'Assault and Battery'

Distracted by 'junk' and panties, TSA perverts often miss fake bombs but rarely a man's 'junk' or a woman's everything! One day --while they're getting their jollies --they will miss a real threat because they are distracted, perverted, and stupid! The TSA should be abolished and the morons sent back to the asylum.

The TSA costs much more than what are called 'rent-a-cops'! The difference is we pay much more for the TSA --some $30,000,000 a day. That is a waste of money when --in fact --the TSA is utterly ineffective but for the threat they pose to innocent passengers. For example, in FAA Red Team security checks, the undercover Red Team successfully carried weapons or fake bombs past TSA screeners an average of 60% of the time.

The TSA has succeeded only in annoying passengers, in some cases assaulting them, feeling them their 'junk' and violating privacy. They make flying an ordeal, a total pain in the ass that I don't need and should not have to put up with! Over the years, I have grown increasingly disenchanted with 'flight'.

How to deal with the TSA

Start filing charges! If anyone from the TSA so much as touches your "junk" have your lawyers charge them with assault and battery.
Assault is an intentional attempt or threat to inflict injury upon a person, coupled with an apparent, present ability to cause the harm, which creates a reasonable apprehension of bodily harm or offensive contact in another. Assault does not require actual touching or bodily harm to the victim. Assault and battery are sometimes used interchangeably, but battery is an unjustified harmful or offensive touching of another. Battery also differs from assault in that it does not require the victim to be in apprehension of harm.

Assault developed in common law, meaning it developed through usage, custom, and judicial decisions rather than from legislative enactment. Modern-day assault statutes closely reflect the ancient common-law definition. An assault is both a crime and a tort. Therefore, an assailant may face both criminal and civil liability. A criminal assault conviction may result in a fine, imprisonment, or both. In a civil assault case, the victim may be entitled to monetary damages from the assailant.

Civil Assault Cases

Separate from any criminal prosecution for assault, a victim may pursue civil damages for injuries caused by it. After a determination by a judge or jury that an assault was committed, the next step is to determine what compensation is appropriate. Three types of damages may be awarded. Compensatory damages, such as medical expenses, are meant to compensate for the injury sustained. Nominal damages are a small sum. Nominal damages act as an acknowledgment that a person has suffered a technical invasion of rights. They are awarded in cases where no actual injury has resulted, or where an injury occurred, but the amount has not been established. Finally, punitive damages may sometimes be awarded. Punitive damages may be awarded in particularly egregious circumstances, as a way to further punish the wrongdoer. Punitive damages go above and beyond compensatory damages.

Have friends farther back that are not obviously connected to you. If they have small devices capable of capturing video, they can record the abuses. Later ---when you have sued the airport, TSA, and the airlines for millions, you will have the entire episode in evidence.

FIND A GOOD TRIAL LAWYER!

PLAN to sue the airlines, the airport, the TSA and the individuals assaulting you. According to the Constitution, you have a right to be left alone unless there is 'probable cause' that you have committed a crime or evidence that you are planning to commit a crime by breaking a law that is on the books.

Sue for millions to compensate you for the mental anguish, the psychological damage resulting from humiliation, invasions of your privacy and persons, and, of course, any damage to your physical person as a result.

For the longer term, don't fly; boycott the airlines and demand that they SACK the TSA. Never, ever support any politician who supports these assaults upon both YOU and the Bill of Rights.
