How to Resist Illegal Police Searches and Violations of the Fourth Amendment!

Commit this to memory:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

--Fourth Amendment, U.S. Constitution
Bottom line --unless the officer wanting to harass you, search your car, pester you or argue with you can PRODUCE a WARRANT issued by a judge that describes 'particularly' the article that you are suspected of possessing, you need not submit to any search whatsoever. You know that! The judge knows that! But 'hot dogs' cops either don't know it or don't care or both!

Most of the time, police must present their probable cause to a judge or magistrate, whom they ask for a search or arrest warrant. Information is reliable if it shows that it's more likely than not that a crime has occurred and the evidence sought exists at the place named in the search warrant, or that the suspect named in the arrest warrant has committed a crime.

The prohibition on unreasonable searches and seizures effectively restricts actions that cops may wish to take but cannot unless they get a warrant. Producing the probable cause is the responsibility of the police and it follows from the 'presumption of innocence'. That's not your problem! The fact is "unreasonable searches and seizures" are illegal if not authorized by a warrant and NO warrant shall be issued but upon 'probable cause'! Therefore, you are not required or expected to do the cop's job for them.

An example of what cops are capable of occurred in Houston some 20 years ago. Cops, responding to a disturbance, arrested an Hispanic Viet Nam war hero who was accused of creating a row in a bar.
He was beaten so badly by the cops that the jailer refused to admit him; he ordered the cops to take him to a hospital. Instead, they took him to a dimly lit area on Buffalo Bayou between downtown and the city's River Oaks/Memorial area. There they beat the holy hell out of him while shackled. Then they leveraged him out over the bridge and DUMPED him into the inky dark waters of Buffalo Bayou some 20 ft (or more) below.

He drowned and the cops --to Houston's credit --were made to stand trial for murder! They were convicted! I covered the trial.

If you should get stopped by a cop who persists and despite not having a warrant FORCES a search upon you, get his badge number!

SUE him! Some attorney's may be willing to take the case for a small fee. ACLU Attorney's are often have a good record of holding 'law enforcement' accountable.

Demand that he be dismissed without pension!

FILE charges against him!

Sue either the city, the state, the district!

Sue the bastards!

The Short List of Bush's Lies About 911

It was Conan Doyle who said:
When you have eliminated the impossible whatever remains however implausible must be the truth!"
Let's put Doyle's dictum to a real world test. Let's see if the Bush conspiracy theory of 911 passes muster. It doesn't! In fact, Bush's every lie shoots down his so-called 'official conspiracy theory' of 911, i.e, a conspiracy of some 19 Arab Hijackers. In the case of 911, there are but two possibilities and one of them --the 'official' conspiracy theory is, simply, a bald-faced lie.

Following is a short list of holes in the Bush conspiracy theory. Any one of them exposes the Bush administration to be --at the very least --complicit liars after the fact. Worse --Bush's overt lies have obstructed justice and facilitated the felony destruction of evidence relative to 911. Only those guilty of a crime are motivated to lie about it! Bush, indeed his administration, lied about 911!

If Bush lied about 911, his sole motivation for lying is called GUILT! Let's consider in turn a short list of Bush's lies about 911!
  1. None of the alleged terrorists can be proven to have boarded any flight let alone those that were said to have been hijacked. CHECK the official BTS records ---NONE of the flights can be verified. I found official and admissible records from AA to the effect that Flight 77 (for one) did not fly on 911. So ---if it did not fly, then how did it manage to crash into the Pentagon?
  2. No Pentagon wreckage was ever traced to any airliner, let alone Flt 77. At the Pentagon, NO airliner wreckage of any kind was ever recovered or traced to any airliner of any sort! How was it able to crash into the Pentagon without leaving behind a SCRAP of wreckage? The ONLY traceable scrap was a SINGLE engine rotor (airliners have 2 engines, thus, 2 rotors)!
  3. The only obvious wreckage was a single engine rotor but it is about 1/3 the size of TWO much larger rotors that would have been left behind had Flt 77 struck the Pentagon. This wreckage was NOT found at the Pentagon simply because 77 never struck the Pentagon.
  4. The ONLY engine rotor that was found at the Pentagon would most certainly have been traced to a U.S. GLOBAL HAWK, a payload carrying missile that can be flown completely by remote control. Google it!
  5. The official autopsy of Pentagon victims was released via an FOIA request to Dr. Olmstead. There were no Arab names on the list.
  6. Hani Hanjour is said by Bushco to have piloted Fl 77! But, according to the Washington Post, Hani Hanjour did not have a ticket! How did he get on board? He didn't! And that is consistent with the fact that there are NO Arab names on the official autopsy report released via an FOIA request.
  7. Flight 77 Cockpit Door Never Opened During 9/11 “Hijack”. Was Hanjour so skinny that he was able to slide under the door and into the cockpit? Had he hoped to take David Copperfield's place?
  8. Pilots for 911 Truth filed an FOIA request and received data that the NTSB claimed was that of Flight 77! The data indicated that Flt 77 was some 200 feet ABOVE the Pentagon at the time it is said to have crashed into the Pentagon. Certainly, even Flight 77 cannot be in two places at the same time.
  9. American Airlines is the source for information that AA Flights 11 (North Tower) and 77 (Pentagon) did not fly on 911.
  10. No wreckage traceable to any airliner was ever recovered in New York.
  11. With respect to New York --airliner fuselages are made of aluminum; both the dense inner core and the outer cladding of the towers was hard steel. As a result, NONE of the alleged airliners could have penetrated either the dense outer cladding or the equally dense inner core.
  12. Neither the core nor the cladding would have melted or weakened by a puny kerosene fire. (Jet fuel is just kerosene) I daresay you would be hard pressed to melt a tin can with a kerosene fire. Try it!
  13. A smoking gun is the confirmed presence of thermite without which the tower would not have collapsed. And --no --the source of the thermite was not the airliners which were 'said' to have crashed into the towers. The towers were, in fact, prepped in advance as is evidenced by the verifiable 'free fall' perfectly matching that of known controlled demolitions.
  14. The fall of the towers look like controlled demolitions because that is what they were in fact!
  15. WTC 7 is one of several smoking guns! It fell at 'free fall'; speed though it had never been struck by any airliner. It must have been prepped in advance. There is simply no other credible explanation.
In law --those who assert MUST PROVE! Bush asserted but PROVED NOTHING! Having no arguments or evidence in his support, Bush THREATENED US. He 'warned' us not to subscribe to outrageous 'conspiracy theories' with one breath and with the very next breath he proposed his own conspiracy theory. It was, in fact, the most outrageous, the stupidest conspiracy theory of them all.

On the topic of 911, Americans will persist in indulging a blind spot, a blind spot that defies intelligence, logic and sanity. Clue: the dictum in both law and debate is this: THOSE WHO ASSERT MUST PROVE! Bush asserted, put forward a 'conspiracy theory' while denouncing conspiracy theories. Bush threatened but offered neither proof nor evidence to support his pack of treasonous lies! And even worse, he literally blackmailed the nation into believing his load of treasonous lies, bunkum and bullshit.

THOSE WHO ASSERT MUST PROVE!

Bush exploited the failure of American education. For example, some 'message boards" have comments like this: "...uh...dude, then who flew the planes into the towars?" The quick response: where's the proof that airliners were flown into skyscrapers? Explaining that is Bush's problem --not mine! It's his cover story, it's his lie, it's his bullshit.

FACT: NO AIRLINER is capable of penetrating the hard steel outer cladding of towers 1 and 2.

Ergo --BUSH HAS TO COME UP WITH A BETTER COVER STORY ---not me! I am merely pointing out HOLES in his THEORY that are so large, you can run a locomotive through them.

What can one do to protect him/herself from rogue cops? There is no panacea, no magic wand. I do have some suggestions:
  • If you should get stopped by a cop who persists and despite not having a warrant FORCES a search upon you, get his badge number!
  • SUE him!
  • Demand that he be dismissed without pension!
  • FILE charges against him!
  • Sue either the city, the state, the district!
  • Sue the bastards!

The Fascist Coup Called 'Corporate Person-hood'

I was asked to explain why a group of individuals should not have the same freedom of action as a singular individual. And I was told so magnanimously to "...feel free to reference any philosophy journal you wish in your response." My response was to ask WHY and HOW a group --which must act 'collectively' -- acquired what even scientists have called a 'conscience'? I asked for an explanation: how may any "group" and especially a corporation exercise a conscience'?

In fact, no collective, no corporation, no club can --as a collective --exercise 'conscience'. A group --were it a person --would be defined by its inability to act upon conscience, to 'feel' obliged to act in ways that are consistent with an ethical position, a morality, or a secular ethic derived from philosophy or logic. As a result of this hypothetical, I have come to suspect that the very purpose of both corporations and the 'movement' to make persons of them is twofold: 1) to raise huge amounts of cash and 2) to allow them to act FREE of moral restraints --restraints that 'real' persons often trace to 'conscience'!

Groups are not individuals by definition! Groups may act upon a consensus! An individual because he/she is an individual is held accountable for his/her crimes, sins or transgressions against society. That is not the case with groups of any sort nor is it the case with 'corporations'. It was the purpose of Citizens-United to put corporations above all that while granting them 'privileges' --privileges that 'real' persons will never enjoy.

One must not mistake a collective of any sort with the individuals who comprise it. A covey is not a quail; a choir is not 'a' soloist; a single violinist is not an orchestra. Nor can one mistake the sound of a choir with that of an individual soloist. Likewise, a 'pride' can never be mistaken for a single lion nor vice versa. An ant colony is not 'an' ant!

Corporate personhood is a hoax if not a bald-faced lie! And, it has been my experience, that no good has ever come as a result of a lie or the embrace of one. Thus --we come to the reasons that the hoax of 'corporate personhood' was handed down by an increasingly crooked and incompetent court. Corporations have, in fact, used their access to wealth to influence political campaigns in ways that individuals could never do! I speak from experience, having consulted several political campaigns in one of the nation's largest cities.

As an individual, I pay my bills! I don't have anything left over with which to influence politicians of any persuasion ---even Libertarians. But what if I were a large corporation with deep-pockets and even deeper connections to the Republican party? As a corporation I could write off my contributions and get a whopping tax break. The scheme is very nearly perfect but for the fact that corporations --not being persons --could be challenged. The corporate support of a political candidate could not be construed to be 'free speech'. But --never fear --the high court, now dominated by GOP appointees fixed all that!

Corporate contributions are now smiled upon. Corporations may now BUY politicians and perhaps the election itself! That is motivation behind Citizens-United. Being "people" can bankroll politicians in any way they wish. They are no longer constrained. We should not be surprised when corporations attempt and purchase elections outright. The word for this is fascism.

I am reminded of A. Hitler's infamous meeting with Krupp, Thyssen, I.G. Farben (the makers of Xyklon B). Hitler literally auctioned off the Third Reich and offered his services as Fuhrer in residence! Corporate personhood is fascism/nazism given a K-street make-over! But the end result is the same: corporations now have a great light to buy the Rei...uh... the republic! And the 'republic' is given a green light to grant whopping contracts to its corporate sponsors. The government has become a soap-box derby.

The term 'artificial person' is an oxymoron but the GOP would like to have it both ways. With Citizens-United, the GOP could have it both ways: the granting of the rights of individual persons to corporations who retained their ability to raise absurd amounts of cash. 'Real persons' are, by definition, real! Now, however, the corporate right-wing' (fascists) expect us to believe that a 'corporation-cum-person' can be both REAL and --at the same time --artificial --For the purposes of raising cash. Real persons cannot do that. But corporations can and Citizens-United was the right wing solution.

Corporations were at one time only formed in the public interest (build a bridge) and dissolved when the reason for their incorporation was finished. This was a legal protection required to get the job done. But, in any case, it does not make a 'legal abstraction' a 'person'! Fact is --people are biological. A corporation is a legal abstraction, the behavior of which is described in a set bylaws filed with a Sec of State --usually Delaware.

A corporation is better described as a 'contract' outlining the parameters of taxation, commerce, bylaw et al! But CONTRACTS are NOT people either. But there is absolutely nothing that can create people our of mere 'legal abstraction'.

Real persons are conceived biologically in a womb! There is a word for that process but this short note is not about sex. Corporations, by contrast, are pieces of paper filed with a Sec of State somewhere (probably Delaware). Ergo: a 'corporation' is not and never will be a person.

A 'corporation' has more in common with and is more accurately described/compared to a piece of paper than to real, living biological persons to whom John Locke and, later, the American founders, ascribed 'rights'. NO rights accrue to a mere legal abstractions but the 'privileges' that are defined and described specifically in a corporate charter that is prepared in advance by REAL people. Corporations can be constrained, restrained and/or limited by law and several hundred years of precedent.

NO intelligent person believes a 'corporation' is a 'person'. Sir/St Thomas More --arguably the most brilliant confidant of King Henry VIII --most certainly did not believe 'corporations' were 'persons'. More believed, rather, that they were 'conspiracies' and 'conspiracies of crooked rich men' to boot:

"I can perceive nothing but a certain conspiracy of rich men procuring their own commodities under the name and title of the commonwealth.They invent and devise all means and crafts, first how to keep safely, without fear of losing, that they have unjustly gathered together, and next how to hire and abuse the work and labour of the poor for as little money as may be. These devices, when the rich men have decreed to be kept and observed for the commonwealth’s sake, that is to say for the wealth also of the poor people, then they be made laws.But these most wicked and vicious men, when they have by their insatiable covetousness divided among themselves all those things, which would have sufficed all men, yet how far be they from the wealth and felicity of the Utopian commonwealth? A hurd is not a cow! A covey is not a quail! An ant is not a colony! A stamp collection is not a stamp nor is a flock a sheep.

So there, Mitt Romney! Read and learn. You are --despite having sold your soul to the GOP --a person! But as real persons are often intelligent and because real persons have a vote (one person, one vote) you will --with any luck --never assume to the high office to which you aspire.

Deceptive, Dubious and Dishonest Origins of Corporate Personhood

The origins of 'corporate personhood' are dubious, suspicious, crooked! 'Corporate personhood' derived from an informal note from a CLERK:
"The defendant Corporations are persons within the intent of the clause in section 1 of the Fourteenth Amendment to the Constitution of the United States, which forbids a State to deny to any person within its jurisdiction the equal protection of the laws."
There are many things wrong with this statement. For a start, the 14th states clearly that its intention is to forbid a state "...to deny to any person ...equal protection of the law." To apply this to coporations assumes that corporations are people to begin with. Logicians call this a circulus en probando fallacy i.e, a circular argument! Lawyers would say that it 'assumes facts not in evidence'! Specifically , it 'assumes' that corporations are people under the 14th and does so in order to prove that 'corporations are people'. Thus an assumption becomes the premise that 'proves' the assumption; in this case an 'assumption' that 'corporations are people'! In fact, corporations are NOT entitled to the protections of the 14th because they are not, in fact, people!

A political agenda was at work! It is in the interests of the 'corporate party' [GOP] that corporations, their benefactors, be considered people. It is in the interests of this corporate party that corporations be granted privileges which, as mere legal abstractions, they would not, do not in any way deserve or warrant! In this way, I can prove almost anything,however fallacious, however stupid, however backward.

The GOP has learned to hide their 'assumptions' among the panoply of crap that is believed by the GOP rank and file in order to feel good about themselves. In fact, this fallacy would not survive a first semester logic course at university; this fallacy would not survive a sophomore high school debate coach.

Again --the right wing is severely, endemically confused about cause and effect, about premises and conclusions. A conclusion cannot be a rationale for a premise! A conclusion may not precede a premise. "One" precedes "two" and 'causes' --without fail --always precede their effects.

'Corporate personhood' was a desired result! One senses desperation at work. Failing authoritative sources --say --the U.S. Constitution or previous decisions of the high court, the five desperadoes, otherwise disguised as 'justices' seized upon whatever sounded good. Scalia is expert at this. His rationale for Bush v Gore, for example, was just as fallacious --a circulus en probando fallacy.
"...to count first and rule upon legality afterwards is not a recipe for producing election results that have the public acceptance democratic stability requires."

The effect was simply this: the re-count was halted while Bush was still ahead! If this fallacy, which in fact works backward from a foregone conclusion, is the basis for SCOTUS's 'corporate personhood' decree then we must conclude that valid opinions of and by real jurists and past courts, several hundred years of jurisprudential traditions dating back to MAGNA CARTA mean nothing to Scalia! In better times, Scalia would have been called out, challenged, tarred, perhaps feathered, made to squawk while flapping his flabby arms.

Five republicans on SCOTUS have nothing but contempt for the concept of 'equal protection under the law' guaranteed to all citizens via the 14th Amendment'. They are contemptuous of the Bill of Rights in general.
"Of the cases in this court in which the 14th Amendment was applied during its first fifty years after its adoption, less than one half of one percent invoked it in protection of the Negro race, and more than fifty percent asked that its benefits be extended to corporations"

The Fourteenth Amendment was one of three amendments to the Constitution adopted after the Civil War to guarantee black rights. The Thirteenth Amendment abolished slavery, the Fourteenth granted citizenship to people once enslaved, and the Fifteenth guaranteed black men the right to vote. The Fourteenth Amendment was passed by Congress in June 1866 and ratified by the states in 1868. The Radical Republicans had been battling with Andrew Johnson for control of Reconstruction. Johnson was in favor of leaving the future of black people in the hands of white Southerners.
The Radical Republicans disagreed, and they won. The amendment was designed to grant citizenship to and protect the civil liberties of recently freed slaves. It did this by granting citizenship to anyone born in the United States and prohibiting states from denying or abridging the privileges or immunities of citizens of the U.S., depriving any person of his life, liberty, or property without due process of law, or denying to any person within their jurisdiction the equal protection of the laws. ("No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.") With the exception of Tennessee, the Southern states refused to ratify the Fourteenth Amendment. The Republicans then passed the Reconstruction Act of 1867, which set the conditions the Southern states had to accept before they could be readmitted to the union, including ratification of the 14th Amendment.

Since Reconstruction, the Fourteenth Amendment -- especially the equal protection clause -- has been applied to a number of cases. It emerged in the famous Brown v. Board of Education of Topeka when the United States Supreme Court used the Fourteenth Amendment as one of its rationales for declaring school segregation unconstitutional.

In 1971, the Supreme Court heard arguments in the case of Reed v. Reed. Sally Reed had sued when Idaho law presumed that her estranged husband should be automatically selected as executor of the estate of their son, who had died without naming an executor. The Idaho law stated that "males must be preferred to females" in choosing estate administrators.

The Supreme Court, in an opinion written by Chief Justice Warren E. Burger, decided that the Fourteenth Amendment did prohibit such unequal treatment on the basis of sex -- the first US Supreme Court decision to apply the Fourteenth Amendment's equal protection clause to gender or sexual distinctions. Later cases have refined the application of the Fourteenth Amendment to sex discrimination, but it was more than 100 years after passage of the Fourteenth Amendment before it was applied to women's rights.

Romney is Wrong! Corporations are NOT People

Mitt Romney has claimed that corporations are people, real people! He even got upset with his audience for daring to challenge his absurd assertions. Now --when corporations are held responsible for their crimes in the same way that individuals, that real people, are held responsible for their crimes, then and only then can I even begin to take seriously the utter BS re: 'corporate personhood' that has been put forward by the GOP, by the extremists on the right wing SCOTUS or by the legion of powerful, wealthy lobbies on K-Street!

The fact is corporations are mere 'legal abstractions'; they are NOT people. The definition of 'people' may be found in biology textbooks; I deny that old men or liars in robes can redefine with a mere decree some several million years of evolution over which they have had no control or input. Robed judges are not 'God' nor can they --with a decree --change the laws of evolution and/or physics.

I deny that SCOTUS may decree that gravity will not work, that Earth will not orbit the sun or the moon, the earth! Say what it will, SCOTUS may not redefine a person; nor may it decree that words on paper may live, breate and procreate biologically as do real people. SCOTUS has no jurisdiction on this point. Rather, some several million years of biological precedent should humble the likes of Scalia.

Nor can I imagine how 'fundamentalists' reconcile their fundamentalist religious beliefs with the ludicrous idea that by squeezing a 'corporate seal' one may CREATE a person, and a REAL person at that! That SCOTUS may be taken seriously could be understandable in a state like Texas, victimized by the GOP assault on education. Texas ranks dead last in high school graduations, thanks to the GOP incompetence of Bush/Perry. However, it is not only Texas under Bush/Perry that has fallen off the radar with respect to education. Education, logic, intellect are always targeted by a party that has made of itself an enemy of erudition, science, logic and, most importantly, good will.

Real people are interchangeable in a corporation --an abstraction. Moreover, anyone can form a corporation for very little money and they can do it by mail order. The corporation is nothing more than 'data' recorded with a Secretary of State (somewhere, probably Delaware), a corporate seal, and a Certificate of Incorporation:

"A corporation is a legal entity [emphasis, EC] created through the laws of its state of incorporation. Individual states have the power to promulgate laws relating to the creation, organization and dissolution of corporations. Many states follow the Model Business Corporation Act. (See Minnesota's adoption.) State corporation laws require articles of incorporation to document the corporation's creation and to provide provisions regarding the management of internal affairs. ERGO: people are INTER-CHANGEABLE in a corporation. A real person doing business as a 'sole proprietorship' does not have that luxury. To create this Orwellian interchangeability, SCOTUS seeks to bestow upon corporations 'privileges', privileges that real people are denied in the same decision.

The law treats a corporation as a legal "person" only in so far as it can sue and be sued. That is not to be confused with either legal or biological personhood. And the reason that it MAY NOT be so confused is that 'suing and being sued' DOES NOT DEFINE a person. If corporations were people, then DuPONT et al should have been put to death for the deaths it caused at Bhopal.

When has ANY corporation --at any time in history --been held to account for the many crimes to include mass murder and other atrocities in the same way that REAL PEOPLE are held to account?

NEVER!

Moreover, the legal independence of a corporation prevents shareholder liability for corporate debts; ERGO, corporations are NOT people. Real people have NO such exemptions, no such luxuries. Corporations are NOT people; SCOTUS, MITT and the GOP are dead wrong. I will be happy to set them straight.

Sue TSA Perverts/Airlines/Airports for 'Assault and Battery'

Distracted by 'junk' and panties, TSA perverts often miss fake bombs but rarely a man's 'junk' or a woman's everything! One day --while they're getting their jollies --they will miss a real threat because they are distracted, perverted, and stupid! The TSA should be abolished and the morons sent back to the asylum.

The TSA costs much more than what are called 'rent-a-cops'! The difference is we pay much more for the TSA --some $30,000,000 a day. That is a waste of money when --in fact --the TSA is utterly ineffective but for the threat they pose to innocent passengers. For example, in FAA Red Team security checks, the undercover Red Team successfully carried weapons or fake bombs past TSA screeners an average of 60% of the time.

The TSA has succeeded only in annoying passengers, in some cases assaulting them, feeling them their 'junk' and violating privacy. They make flying an ordeal, a total pain in the ass that I don't need and should not have to put up with! Over the years, I have grown increasingly disenchanted with 'flight'.

How to deal with the TSA

Start filing charges! If anyone from the TSA so much as touches your "junk" have your lawyers charge them with assault and battery.
Assault is an intentional attempt or threat to inflict injury upon a person, coupled with an apparent, present ability to cause the harm, which creates a reasonable apprehension of bodily harm or offensive contact in another. Assault does not require actual touching or bodily harm to the victim. Assault and battery are sometimes used interchangeably, but battery is an unjustified harmful or offensive touching of another. Battery also differs from assault in that it does not require the victim to be in apprehension of harm.

Assault developed in common law, meaning it developed through usage, custom, and judicial decisions rather than from legislative enactment. Modern-day assault statutes closely reflect the ancient common-law definition. An assault is both a crime and a tort. Therefore, an assailant may face both criminal and civil liability. A criminal assault conviction may result in a fine, imprisonment, or both. In a civil assault case, the victim may be entitled to monetary damages from the assailant.

Civil Assault Cases

Separate from any criminal prosecution for assault, a victim may pursue civil damages for injuries caused by it. After a determination by a judge or jury that an assault was committed, the next step is to determine what compensation is appropriate. Three types of damages may be awarded. Compensatory damages, such as medical expenses, are meant to compensate for the injury sustained. Nominal damages are a small sum. Nominal damages act as an acknowledgment that a person has suffered a technical invasion of rights. They are awarded in cases where no actual injury has resulted, or where an injury occurred, but the amount has not been established. Finally, punitive damages may sometimes be awarded. Punitive damages may be awarded in particularly egregious circumstances, as a way to further punish the wrongdoer. Punitive damages go above and beyond compensatory damages.

Have friends farther back that are not obviously connected to you. If they have small devices capable of capturing video, they can record the abuses. Later ---when you have sued the airport, TSA, and the airlines for millions, you will have the entire episode in evidence.

FIND A GOOD TRIAL LAWYER!

PLAN to sue the airlines, the airport, the TSA and the individuals assaulting you. According to the Constitution, you have a right to be left alone unless there is 'probable cause' that you have committed a crime or evidence that you are planning to commit a crime by breaking a law that is on the books.

Sue for millions to compensate you for the mental anguish, the psychological damage resulting from humiliation, invasions of your privacy and persons, and, of course, any damage to your physical person as a result.

For the longer term, don't fly; boycott the airlines and demand that they SACK the TSA. Never, ever support any politician who supports these assaults upon both YOU and the Bill of Rights.

Right Wing Scams: 'Why Don't You Start Calling Me Gordon?'

All but forgotten now, Enron --it's rise and calamitous fall --dominated front pages and sucked up airtime until knocked out of contention by 911. As I was reminded, it was the ghost of Gordon Gekko, brilliantly portrayed by Michael Douglas in 'Wall Street', who both presaged and haunted the fail of Enron and all those who served it or were temporarily enriched by its corporate shams and schemes.

As was the case in the 'Roaring Twenties', fortunes were lost in a heart beat, economic empires collapsed in the blink of an eye. Enron was one of them. Conveniently for the new Bush administration, indeed, the GOP itself a crime syndicate, corporate 'person-hood' benefited from a timely stay of execution -- 911.

Wall Street was one of Hollywood's more pertinent parables even if the name "Gekko" was a bit obvious. Real Gekkos (spelled Gecko) make fairly good pets --or so I am told! They eat roaches. And of late there are no shortage of roaches. The largest roach colonies are found in Washington D.C., Austin, TX, K-street or Wall Street --all sites of irradicable infestations. As we have seen, the GOP eats it own.

Opportunities for metaphor and analogy are endless and every comic needs a foil. Had there been no crooks or idiots, the careers of Voltaire and Mark Twain would have been much less brilliant. We owe a great debt to totalitarians, snobs, goppers, corporate crooks, Bush's surrogate torturers and would-be dictators. Where would Stephen Colbert be without them? Alas, the blog-o-sphere would be scrambling for material.

Enron was run by a gang that most certainly thought that, being "captains" of "industry", they could just pull out and disappear. I suppose every crook thinks that they will get away with it.
Enron will prove to be one of the most important episodes in the history of American business, and its story, from beginning to end, is inseparable from Ken Lay, its founder and long-time chairman. Thus, what people make of Enron—and what lessons they draw from it—will depend to a considerable degree on how they understand Lay.

As I’m sure you know, Enron has to date been blamed largely on free-market politicians, heartless corporate managers, and an egoistic chairman. In fact, as my book will show, Enron relied heavily on government favors, was run by postmodernist managers, and had as its chairman the kind of person Ayn Rand would have called “a second-hander.”

The US is, likewise, a financial shell. When GM, at last, is swallowed up by a foreign auto maker, what incentive will the new entity have to employ American workers when they can do just as well in Japan or Malaysia or China?

We have become a nation of consumers lent money by China so that we can buy goods manufactured in China. We are cattle, cows to be milked. When the teat runs dry we will be abandoned to third world status if we are not already.

In the meantime, the Bushies and other GOP Geckos will have run off with the last scraps of US wealth if they have not done so already. See the CIA's World Fact Book which lists the U.S. at the very bottom of the list with the world's largest negative Current Account Balance, formerly called the 'balance of trade deficit'. China tops the list with the world's largest POSITIVE Current Account Balance. Every banker can equate that with his own balance sheet and conclude that China, because of the policies of the GOP, now owns America if not the entire world.

The house of cards appears to have fallen --but not just yet! Like Ken Lay, Bush and his gang are most surely clinging to the belief that, unlike Lay, they will get away with it. Chances are good that Bush will live out the rest of his wasted life too stupid to regret a damn thing! It is this luxury, available only to the stupid, that I resent most!

Iraq was a big screw up. The invasion and theft of Iraqi oil was supposed to bail them out. Things have not quite worked out as planned. Then again, perhaps they have exceeded Bushco expectations. They are not yet jailed nor executed for capital war crimes (see: U.S. Codes, Title 18, Section 2441).

Just as Hitler thought he had learned from Napoleon's mistakes, Bush most certainly thought he had learned from Hitler's.

Wingnuttery gets more absurd with each passing day. The wingnut la-la land has come un-glued and completely out of touch with reality. Found on Facebook a poignant reminder of the state of the economy, fact apparently lost on wingnuts!
Here's where I get my stamina and keep my sanity to:
  • - Apply for 30 jobs a week for 12 weeks and never hear back
  • - Spend 3 hours weekly with the bank to keep my home
  • after 4 months and 4 mortgage applications, send in the 5th mortgage application for the 5th month.

Now --the right wing has derided Barack Obama's plan to put millions to work in a new industry --green energy! The right wing is in no position to deride anyone. This is the US right wing that put millions out of work with idiotic tax cuts and other windfalls for Wall Street banksters, buddies, cronies, stall buddies and privileged elites. To these idiots and elites, I have an appropriate epithet that begins with the letter 'F' and ends with 'you'!

Realistically, 'green energy' has a future. A world without it doesn't! It is a better, a brighter future than, say, a lifetime career in government run pits in which are dug out dollar bills made worthless by GOP 'sellouts' to China and Japan. What if the plan should put millions back to work and re-stimulated the economy?

What if it should fail? So what! We'll be no worse off! We we would be no worse off if it failed to create a single job! We will be considerably better off if it should put a million or more back to work! And infinitely better off if, by exploiting this new resource, America should find its better self again, a new industry, a future for millions now without hope!

It is not surprising that the geniuses of the utterly failed 'right wing' have the derided the idea. Keep in mind that these are the same folk that think 'privatization' of Social Security, letting the big banks who have brought us to the brink of utter economic collapse, administrate your retirement is a brilliant idea!

IDIOTS!!

These are the idiots who lambaste an Obama plan to create millions of productive jobs in green industries! I say Obama's plan is infinitely superior to the idiots' plan to turn over the only government program to have ever run a surplus to robber barons, speculators and fast buck artists on Wall Street!

The US economy collapsed because it contracted. It contracted because it produces very little that the rest of the world wants to buy. Check The CIA's World Fact Book for proof of this. The US is at the bottom of the list with the World's largest trade deficit, now called the Negative Current Account Balance. China, which props up the dollar as per agreements with the Bush crime family, is on top of the CIA's list with the world's largest positive Current Account Balance.

There was never a real opposition, i.e, a 'left wing' in America. The US system is just two wings of one party and there was, therefore, no restraint, no balance, no moderating influence as a result of 'compromise'.

$ 150 billion spent on windmills, solar panels and 'energy efficiency' is a drop in the bucket compared to the trillions squandered and lost forever as a result of the overt criminality of the big banks in cahoots with the Fed. That's money lost forever, a contraction of the economy that caused the current depression! Obama's plan will create some 5 million jobs and promote economic growth. Obama could not do worse and, most certainly, will do better than a plan first proposed by John Maynard Keynes.

It's time the US went back to work after having been told by the Reagan/Bush regimes that the US could survive by exporting its 'expertise'! Uh huh! Expertise in what?? The US is now paying the price for having abandoned its industries, having sold out to China, having stabbed labor in the back! The US never had a viable 'labor movement' that, in Poland, resulted in the fall of the communist regime. In America, by contrast, labor was derided as 'communist' and, under Ronald Reagan, made 'irrelevant'. Reagan cannot be 'credited' with having single handedly neutered the movement. The many professional murders by Pinkerton's, the Jihad waged by Gen. Harrison Grey Otis (Los Angeles), the hundreds, perhaps thousands, of lesser known atrocities paved the way.

Having marginalized dissent, Reagan tax cuts enriched only the upper quintile, the nation's richest twenty percent. The trend was clearly visible in charts prepared by the Brookings Institution, BEA, the Bureau of Labor Statistics et al. Just as clearly was the brief reversal in Bill Clinton's second term. Alas, all 'gains' were lost under Bush Jr. Today --just one percent of the US population owns more than some 95 percent of the rest of us combined. The time has come to take another look at Keynes. Obama's plan is, at least, a start.
In the 1920s Keynes visited Russia, where he was able to meet some of his wife's impoverished relatives. Unlike his friends Beatrice and Sidney Webb, or the dramatist George Bernard Shaw, Keynes wasn't impressed by Stalin's Russia. "How can I accept a doctrine," he asked, "which sets up as its bible, above and beyond criticism, an obsolete economic textbook which I know to be not only scientifically erroneous but without interest or application for the modern world?" But Keynes was barely more enthusiastic about capitalism as it was practised in the contemporary world. "Such a system," he wrote, "has to be immensely, not just moderately successful to survive." The Great Slump made it clear that capitalism was neither.

The current 'crisis' was a long time in making. Compounding the problem are several factors; 1) the 'elite' one percent are joined at the hip to the Military/Industrial complex. Like Rome, the US makes its 'living' killing people in those foreign nations rich in the resources needed by the US, 2) under Ronald Reagan, the US had begun an 'export' of jobs, most notably Japan and China; 3) education is neglected in America, the best example being Texas where the percentage graduating high school slipped to last in the nation --the result of back to back incompetent regimes: Bush and Perry. Texas now beats out Mississippi for dead last in education. Concurrently, the state's prison population is burgeoning, enriching the corporations to whom was awarded the contracts in which they house the thousands (millions nationwide) for whom the only career left them is crime.

In the meantime, there is secessionist talk and not just among rednecks, death row inmates in Texas, or tea bagging imbeciles down south.
CHATTANOOGA, Tenn. (AP) — In an unlikely marriage of desire to secede from the United States, two advocacy groups from opposite political traditions — New England and the South — are sitting down to talk.

Tired of foreign wars and what they consider right-wing courts, the Middlebury Institute wants liberal states like Vermont to be able to secede peacefully.

That sounds just fine to the League of the South, a conservative group that refuses to give up on Southern independence.

"We believe that an independent South, or Hawaii, Alaska, or Vermont would be better able to serve the interest of everybody, regardless of race or ethnicity," said Michael Hill of Killen, Ala., president of the League of the South.

Separated by hundreds of miles and divergent political philosophies, the Middlebury Institute and the League of the South are hosting a two-day Secessionist Convention starting Wednesday in Chattanooga.

I submit that the Southern Secessionists are still nuts! The economy of the south is in no better shape that it was when it was based almost entirely upon slave labor. What does the South export now except bigots, bullshit and tours of Plantation homes where the great grandfathers of bigots convinced themselves that they were 'aristocrats'! As the Rude Pundit put it so eloquently --fuck the South!

Screw the Big Banks! Bailout the Small Depositors!

It was last fall, as Americans dared hope that a new administration would take office just in time to save America, Bush announced a first big 'bailout' which would, we were told, prevent a financial collapse, a great depression, a panic! Not least among many reasons the bailout failed is the fact that the wrong people got the money. 

Although Richard Nixon had famously claimed "We are all Keynesians now", nothing could be further from the truth now.Thanks to the misplaced reverence for Augustus Reagan, we are all still Friedman monetarists --not Keynesians. That is why the bailout failed and it is the reason future bailouts will fail unless something is done to address the root cause of collapse: the wrong people got the money! 

It was only last fall that the FED and officials of the Treasury Department 'rode to the rescue' of all the wrong people, specifically, the very financial institutions that created this mess to begin with. In the wake of all this failure, incompetence and criminality, there was great hand wringing, wailing, gnashing of teeth because the 'n' word had been uttered. Nationalize the banks! At this point, it won't make any difference.As 'the Who' famously said, 'the new boss, same as the old boss'. What is needed is not a new boss following the same, tired, failed policies. What is needed is some intelligent thinking about what drives economies! Here are some clues: banks do not drive economies. Rich elites do not drive economies. Governments do not drive economies. Big corporations do not drive economies though many board chairs are deluded and believe themselves to be 'captains of industry'. Bullshit!
More than 83 corporations have offshore subsidiaries where their funds are protected in tax havens in the Caymen islands such as: The Bank of America, Citigroup, Morgan Stanley, AIG, JP Morgan Chase, Wells Fargo, and even Pepsi and General Motors who received 13.4 billion have hundreds of millions of dollars in tax havens offshore. All these corporations receive protection from paying the US government their taxes and the loss to the US is into the 100 billion dollars of lost tax revenue.< Senator Carl Levin a democrat from Michigan and Byron Dorgan, Democrat of North Dakota requested the report to be released and are pushing for new laws prohibiting these bailout scam corporations from being tax dodgers while asking for bailouts from the taxpayer
The Government Accounting Office includes 63 of the 100 largest contractors who receive government contracts also have accounts in tax haven countries.

The bailouts failed because the wrong people got the money. The government would have done better had it just put billions of dollars in mason jars, buried them in a land fill and let the unemployed dig them up! That is as true now as when Keynes first proposed it back in the thirties. You can bet those folks would have spent the money and, by doing so, revived the collapsing, moribund GOP economy that Bush left us.  

Instead, Bush gave the money to fat cats who parked it in offshore tax havens --a fact that may be solely responsible for the worst contraction of the US economy in a quarter century, an annualised 3.8 percent in the fourth quarter of 2008! That's the worst result since 1982, the year of Ronald Reagan's big tax cut. It was also the year of the 'Reagan Recession', the worst since Herbert Hoover's GOP 'Great Depression'!
Of the 100 largest public companies, 83 do business in tax-haven hotspots like the Cayman Islands, Bermuda and the British Virgin Islands, where they can move their income into tax-free accounts. .In the list of 100 companies that GAO studied were 63 with major federal contracts, including Caterpillar, BearingPoint, Boeing, Merck & Co. and Kraft Foods. ...Legislators gave particular attention to the 14 companies on the list that received bailout money from the Treasury in the recent financial meltdown.

In the meantime, more banks are going bust. Let them fail! Fuck the banks.
With two of the nation’s largest banks buckling under yet another round of huge losses, the incoming administration of Barack Obama and the Federal Reserve are suddenly dealing with banks that are “too big to fail” and yet unable to function as the sinking economy erodes their capital.

Particularly in the case of Citigroup, the losses have become so large that they make it almost mathematically impossible for the government to inject enough capital without taking a majority stake or at least squeezing out existing shareholders.
And the new ground rules laid down by Mr. Obama’s top economic advisers for the second half of the $700 billion bailout fund, as explained in a letter submitted to
  • Congress on Thursday, call for the government to play an increasing role in the major activities of the banks, from the dividends they pay to shareholders to the amount they can pay executives.

We should have been bailing out the depositors. By 'depositors', I am not talking about big corporations, who, like the banks, have taken monies out of the US economy. For example --General Motors which pocketed $13.4 billion and then promptly squirreled it away in 11 offshore subsidiaries. GM's 'financing arm, GMAC received $5 billion in bailout and quickly exported to two offshore units. 

GMACs majority owner is the private equity firm Cerberus Capital Management LP. Boycott them!If Obama were a part of the 'revolution', he would have already nationalized the crooks, seized their assets and put the monies back into the hands of original depositors whose expenditures would most certainly revive the ruined economy that the GOP thinks it has washed its guilty hands of. The trend in which an increasing tiny elite of about one percent of the total population would end up owning more than the rest of us combined is, at last, having the effect I warned about.

The Reagan years can be summed up briefly. He doubled the size of the Federal Bureaucracy and tripled the national deficit. The most pernicious effect of GOP economic policy is the effect of declining opportunity, a corollary of decline in wealth among all but the very rich.It is merely rhetorical to ask: why does the GOP seem to repeat ad nauseam utterly failed strategies that have never been shown to work? Reagan's Budget Director, David Stockman called Reaganomics a 'Trojan Horse'. He understood that tax cuts were not intended to trickle down. 

That's just how they are sold. Rather --the tax cuts always do precisely what the GOP insiders know they will do: they enrich the GOP base! They are 'laundered' pay offs. Thanks to enlightened tax policies during the administration of FDR, the US was at its most egalitarian throughout WWII and the post war era. Things did not change dramatically until the rise of 'Reagonomics', a polite word given the transfer of wealth upward to those already rich and will only invest it offshore where it cannot possibly help provide jobs at the local level. This is truly 'mainstreet' vs 'Wall Street'.

The rise of Ronald Reagan brought with it a spreading of wealth upward to the upper classes and Wall Street insiders, in fact, an increasingly tiny elite of just one percent of the nation which owns more than 90 percent of the nation's total wealth. That fact is graphically illustrated above. The result is factually documented by the government's own agencies --Census Bureau, Bureau of Labor Statistics, Department of Commerce-BEA, et al. Income inequality is measured by what economists call the GINI index. The higher the GINI, the greater the inequality. These numbers, recognized and cited by economists from Friedman to Krugman, from Keynes to Galbraith, invariably increase during GOP regimes.Now --as the late Steve Kangas pointed out, 'conservatives' will claim that correlation is not 'causation'. I think conservatives are wrong on that point, but if, in fact, GINIS always go up under GOP regimes, what difference does it make?The pragmatic solution is simply this: fire the GOP! Permanently!

The 'contraction' of an economy is typically called a 'depression'. The US economy is contracting due to 1) the transfer of wealth to but about one percent of the population; 2) this 'elite' has transferred most of its wealth offshore where it has absolutely no good effect on the domestic US economy. The current collapse of the US is the end result of a trend that was begun with the passage of Ronald Reagan's infamous tax cut for his rich, elite base. The year was 1982. Historians willl write of that date that it was the beginning of the end of the American empire.

Bush sticks you with the bill

In the conduct of his war crimes, capital crimes and naked aggression, Bush ran up the largest debt and deficit in US history! The Iraq war to date is estimated to have cost you over $3 trillion --'financed' in the short term with phony-baloney "'GOP" money.

Now that the bill has come due, Bush blackmails the American people with an offer you dare not refuse; do it Bush's way or face a 'crisis'. Bush expects you to foot the bill for his bail out and that of his crooked Wall St insiders. Bush must be surprised that the crash has happened before he could make good his get-away to Paraguay!

We got to this point because the US government has been hijacked by Wall Street. For years, the US government has borrowed money from the Federal Reserve Bank of New York --a private bank, not a government agency. Federal Reserve Notes are not backed up by anything. To finance its profligacy and incompetence, the government --GOP regimes primarily --simply cover all current expenses with Federal Reserve Notes.

The FED literally creates money which is loaned to the government at interest.
The private Federal Reserve owners don’t have a trillion dollars to lend the Government, nor do they need it. All they do is create it, via a bookkeeping entry, and write a check to the U.S. Government as the loan in exchange for the U.S. Bonds. The U.S. Government banks at the Federal Reserve Bank so cashing this check is very easy.

No hard currency is exchanged. Government agents are never seen walking out of the FED offices --under armed guard --carrying bullion, coins, or, indeed, anything of real value. The Fed makes an 'entry' in the books! The government makes an entry in its books!

Here's how the 'bail out' scheme will work: US Treasury Secretary, Hank Paulson will set up a Federal agency to buy up $trillions$ in bad debt --debt for which you are stuck because just enough people supported Bush to make the election 'steal-able'. The bankers who conspired with Bush get off scot free and laugh all the way back to the bank.

John McCain, meanwhile, expects you to entrust these same Wall Street crooks with the good money that you have already paid into the Social Security trust fund. Had McCain's plan already been effected, every retiree in the US would now be left penniless and destitute! That scenario could still happen, if the GOP should get away with stealing the election for John McCain.

George W. Bush has warned that the 'entire US economy' is in crisis. Specifically, the US faces a long-term recession if the government does not act! The problem is Bush's prescription: another bailout, another handout, another reward for the Wall Street insiders whose greed and incompetence created the crisis. It's the GOP way: just keep on doing whatever it is that makes you sick!
"I believe companies that make bad decisions should be allowed to go out of business," Bush said. "Under normal circumstances, I would have followed this course. But these are not normal circumstances."

When the GOP uses the terms 'crisis' and 'money' in the same sentence --hold onto to your wallet. This time you are required to pay the blackmailers some $700 billion, while bending over.

Like Reagan earlier, the Bush administration has looted the US Treasury and again, like Reagan, wiping out the American middle class. Instead of bailing Bush out, we should be frog marching Bush --in chains --out of the White House. For too long the apparatus of government has been hijacked by thieves, perverts, and mass murderers. For too long the US government has been exploited as the enforcement arm by which a crooked, corporate establishment rules America. The proper word for this is 'fascism'. For some time now, the government of the US must be properly described a fascist dictatorship!

The GOP expects you to reward them in that amount for their crookery, their greed, their wars of naked aggression, torture and atrocity. They expect to be 'paid' for having robbed you. They expect to be returned to office for having been crooks, liars and failures.

The profligate GOP ran the nation on charge cards, maxed them out, consolidated and maxed out again and again! The GOP expects you to pick up the TAB while Bush beats a hasty retreat to South America without leaving a forwarding address. Your response should be: screw you!! We should follow up with criminal charges against the GOP leadership.

Bush claims the market was not functioning properly. At this point, I am confused! Hasn't the GOP repeatedly told us about the utter infallibility of 'free markets'. Or was that just another lie used to get your money? What happened to Adam Smith's 'invisible hand'? Or did they mean 'invisible hand job"?
More financial distress could lead more banks to fail, the stock market to drop further, businesses to close, job losses and home values to drop, Bush said.

"And, ultimately, our country could experience a long and painful recession," Bush said. "Fellow citizens, we must not let this happen."

I really hate it when someone demands I make a life or death decision while holding a gun to my head. I hate it when that happens.
I would guess that this has to be one of the biggest peacetime transfers of power from Congress to the Administration in history. (Anyone know?). Certainly one of the most concise.

The Treasury Secretary can buy broadly defined assets, on any terms he wants, he can hire anyone he wants to do it and can appoint private sector companies as financial deputies of the US government. And he can write whatever regulation he thinks are needed.

I have a better plan. It consists of rounding up every GOP idiot who supported the war against Iraq because it was thought that the theft of Iraqi oil would lower the price of oil and thus the price they pay to fill up their SUVs! Give these idiots the bill! Let them cough up that money as best they can. Bush was their hero. Let them bail his sorry ass out! Busk a queue! Sell greeting cards door to door!
