The GOP Record in Texas May Predict the Future

If Texas is the GOP 'lab' experiment as some have said then one may be justified in drawing several conclusions:
  • In TX, the GOP deliberately neglected education; high school graduations dropped to dead last (nationwide) under Bush/Perry;
  • As a result, crime rates rose; Dallas became the nation's murder capital;
  • Only the CORPORATE OWNED prison system benefited from the resulting rise in crime which the GOP had the NERVE to demagogue!
The GOP is not a political party; it's a crime syndicate with characteristics of a kooky whacked-out cult! Now they want to apologize to the ruling 1 percent that their stupid, incompetent economic policies created by
  1. exporting U.S. jobs and industry to China;
  2. creating a vast gulf between rich and poor;
  3. attacking Detroit, a city that had been the center of a VIABLE U.S. auto industry.
The GOP would make quick work of that! Now we import cars from Japan. And how about Pittsburgh? It was at one time the center of world steel production. Alas ---the GOP POX struck there as well. You will find Japan making and exporting their steel and employing their work force in the process. If you wish to see the result of GOP policy, specifically, the effect of GOP incompetence upon America's stand in the world, you need only visit the CIA's World Fact Book. China is at the very top of the list with the World's Largest Positive Current Account Balance. That ranking is the result of the fact that China manufactures products and, notably, sells them to the U.S. by way of Wal-Mart.

Now --scroll down to the bottom of the list. That's where you will find the United States, dead last with the World's largest NEGATIVE Current Account Balance, formerly called the Balance of Trade Deficit.

The GOP deserves NO respect and gets none from me. The GOP should run for office in either China or Japan as both nations have benefited greatly from the policies of the GOP! Certainly --the U.S. of A has not benefited but suffered at the hands of a 'party' that is either crooked or incompetent or both!

Why We Are Not Free

While it may be true that all societies indulge a process called 'criminalization', it seems that in the U.S. the process has been to an even greater extent institutionalized. Both crime rates and the profits of the so-called "Prison Industrial Complex" (P.I.C.) depend upon the criminalization of various behaviors, most notably, the cultivation and/or use of marijuana, a so-called 'drug' which many believe and support is not only hamless and non-addictive, its many uses could be of tremendous benefit to society.

'Criminalization' is often 'race-based', perhaps intended to justify endemic prejudice or bigotry. There is no reasonable doubt that persons of color are more often targeted by law enforcement. A study conducted in 1996 focused on Interstate 95 in Maryland; it found that almost 75 percent of motorists stopped for alleged traffic violations were 'black' though 'black' motorists constituted less than 18 percent of all motorists on Interstate 95.

Minorities are, likewise, more often to be surveilled! Such surveillance includes 'electronic monitoring' --video, audio, mail, etc. These tactics are often employed as devices of intimidation. That is most often the case with 'political dissidents'.

The answer to the question --'who gets watched' --defines the sweep and depth of surveillance as a means by which the 'state' may monitor and restrain citizens of any color or political persuasion. As a result, the mere present of police becomes an omnipresent means by which 'social control' is maintained. The presence of 'police' is a constant reminder that 'big brother' is watching. The message is clear: the police may routinely resort to violence to maintain a status quo beneficial to but a mere segment of the total population.

How Citizens United Subverted the Rights of Real People

I've often written about the detailed and vivid account of A. Htler's meeting with top German industrialists --Krupp, Thyseen, I.G. Farben et al. It was in that meeting that the German fascism was made real in terms of an agreement between the Reich and its 'fascist' sponsors, the huge corporations who would benefit from aggression, death and destruction. The meeting may not have defined the word 'fascism' but it most certainly birthed a Nazi regime in which corporations were given and promised not only privileges but, most importanly, big juicy contracts.

From a lesser known source is another detailed description of the nature of Hitler's fascist partnership with big business:
"From now on, the government in Berlin will allocate large sums to industrialists so that each can establish a secure post-war foundatin in foreign countries. Existing financial reserves in foreign countries must be placed at the disposal of the party in order that a strong German empire can be created after defeat. It is almost immediately required," he continued, "that the large factories in Germany establish small technical offices or research bureaus which will be absolutely independ and have no connection with the factory. The bureaus will receive plans and drawings of new weapons, as well as document which they will need to cotninue their researh. These special offices are to be established in large cities where security is better, although some might be formed in small villagtes nears sources of hyrdropeletric power, where these party member can pretend to be studying the development of water resources for benefit of Allied investigators."

Some have said that the 'brand' of fascism now emerging in Western democracies, the U.S. in particular is a completely new phenomenon. I disagree! The odious 'Citizen-United' decision, in which SCOTUS decreed that corporations were 'persons', is an open and odious declaration that a corporation may utilize its wealth, riches and privileges to enslave a population of 'real people' whose humanity is as self-evident as Thomas Jefferson had declared of 'real' persons in our own 'Declaration of Independence":
We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed...
Earlier, John Adams had written of the same concepts in somewhat different words:
All men are born free and equal, and have certain natural, essential, and unalienable rights; among which may be reckoned the right of enjoying and defending their lives and liberties; that of acquiring, possessing, and protecting property; in fine, that of seeking and obtaining their safety and happiness.
Now, of course, we know that these rights extend to women as well. Surely --even our crooked court must understand that. Even so, the Roberts court cannot be trusted to defend the rights of persons of any color, creed or sex. Our court cannot be trusted to recognize an even older and more venerable position: that governments derive their power power, right and right of power from the peole who are ---alone --sovereign!

We must not be surprised to find among GOPPERS an obsessive fascination with all things 'German' --inclinations, interests, political philsophies. Paul Ryan, Mitt's desperate choice for running mate, now says that Ayn Rand is not his only idol; he says that in his offices, NIETZCHE is required reading, though he is accurately described with just two words: "moral Platonist". It was Neitzche who described the world as nasty and brutish and life as short.

FREE JULIAN ASSANGE! OCCUPY THE WORLD!

Julian Assange has been in 'custody' illegally! His right of 'habeas corpus' has been denied him though not formally. He is simply detained, denied his freedom of movement and, presumably, his access to the international press! In fact, no charges have ever filed against him. No 'probable cause' has been demanded of his captors by any judge. He is a political prisoner in every sense of the word. He may be the picture of a fascist future when 'authority' or 'force of arms' simply decrees one to be an enemy of the state.

Assange is locked up though the burden of proof in almost every western nation has rested upon those making accusations. In this case there is no 'probable cause' whatsoever that Assange committed any crime. No formal charges have been filed against him! Officially, he has not even been accused of a specific crime. He is a political prisoner. He is a 'captive' of a crooked state(s).

TYRANNY
The arrest warrant for Julian Assange should not stand and breaches "a matter of fundamental legal principle", the supreme court has heard .

Dinah Rose QC, defending the WikiLeaks founder in his final appeal against extradition to Sweden to face allegations of sex crimes, told the panel of seven senior judges that to consider the Swedish public prosecutor as a judicial authority was "contrary to a basic, fundamental principle of law".

Reaching back as far into European legal history as the Codex Iustinianus, dated 376 AD, Rose said the Swedish prosecutor was a party in the Assange case and therefore not independent and impartial, breaching the principle that "no one should be judge in their own cause", which Rose said was one of the pillars of natural justice.

This is an outrage! Everyone should be outraged! If Julian Assange can be imprisoned though NO CHARGES have ever been lodged against him, NO ONE IS FREE!

When the U.S. Bill of Rights had not yet been trashed, subverted by the likes of George W. Bush, the crooked court made crooked by the likes of Thomas, Scalia et al, the Bill of Rights had GUARANTEED every American DUE PROCESS OF LAW. The principle, it was hoped, would have been universal among 'western nations'. In fact, no one should be denied the right of Habeas Corpus.
Latin for "that you have the body." A writ of habeas corpus is used to bring a prisoner or other detainee (e.g. institutionalized mental patient) before the court to determine if the person's imprisonment or detention is lawful. In the US system, federal courts can use the writ of habeas corpus to determine if a state's detention of a prisoner is valid. A habeas petition proceeds as a civil action against the State agent (usually a warden) who holds the defendant in custody. It can also be used to examine any extradition processes used, amount of bail, and the jurisdiction of the court.

Simply, if charges cannot be found and filed upon PROBABLE CAUSE, the person targeted should be, must be released! Habeas corpus originated in the English legal system, embraced by the American founding fathers, and made law in the Bill of Rights! It is, likewise, guaranteed in many nations.

Make the Right of Habeas Corpus a Principle of International Law. It is an essential safeguard against tyranny, arbitrary state action, 'official vendettas! ORGANIZE to demand that Julian Assange be 'arraigned' and the charges against him HEARD together with the probable cause that he violated ANY LAWS WHATSOEVER. If the 'authorities' don't even have enough 'probable cause' to file a formal complaint with a judge, then ASSANGE MUST BE RELEASED!

The Fascist Origins of 'Corporate Personhood'

Many sources support my assertion and emerging thesis: the concept of 'corporate personhood' has Germanic, fascist roots. Herr Schlegel, for example, wrote an essay entitled “Signature of the Age” (Signatur des Zeitalters, 1820). Amid his attacks on British-American "parliamentary government" may be found his Mitt Romney/SCOTUS-like descriptions of a "machine-like", ideal state.

Schlegel describes his ideal with the term "organic" --though it is not! Schlegel also used the term 'Christian' to describe his 'fascist' state. His 'Christian corporations', he said, were 'living wholes' and he described them in terms not unlike that of the corporatist (fascist) philosophy that had been espoused/advocated by Hegel.

Some hard background: in England, ‘the Crown’ has been regarded as a 'legal entity' for centuries. But that is not to say that the 'Crown' IS 'a person'! It simply does not follow that because the 'Crown' may exert power and/or authority it is a 'person'.

Likewise, it simply does not follow that because 'corporations' may enter into contracts that the said 'corporation' is a person. In the case of the 'Crown', for example, it was said that it was both a source of law and the means by which it was enforced! This, it is said, put it above 'laws' --laws which people, real people, are expected to obey. Ergo: the 'state' is, likewise, not a person.

It is said that 'all modern societies' recognize the 'legal existence, as persons, of companies or corporations'! Again --many things may be asserted! It was often asserted that the world was flat; saying so did not make it true.

Corporations do not procreate sexually; corporations do not grow, fart, belch or have babies. Corporations do NONE of the things that define 'real people' either biologically or psychologically. A 'corporation' is nothing less than a paper contract outlining how and possibly when they may interact with 'real people' and with other corporations. NONE of these 'privileges' imply or bestow upon a 'corporation' either a sexual or asexual means by which they may procreate; NONE of these 'privileges' have either the evolutionary power or the 'God-like' power of bestowing upon a mere paper contract the status of 'personhood'.

SCOTUS was wrong and wrong-headed and so are those members of the GOP who bought the scam!

Some have said that a corporation is an 'artificial' person! But a 'real person' is ...uh...a 'real' person! A corporation is not by definition! Black's Law definition is disingenuous. Neither dictionaries nor ill-informed legal decisions can make people out of what are --in fact --mere contracts. Existence precedes 'essence' and it is 'essence' which defines! People are what they are upon birth. Corporations share none of characteristics which define what it means to be a person!

Contracts which, in effect, create a 'corporate entity, differ from other contracts only because they are normally on-file with a Secretary of State somewhere. But that hardly makes of them a 'real person'. They simply outline the legal scope of responsibilities of those party to the contract. See the quote by St. Thomas More who said of them that they were, in fact, '...conspiracies of rich men to procure their commodities in the name and title of the commonwealth'!

When the Sec of State in Delaware (for example) affixes his SEAL upon the articles of incorporation he has performed in a manner PRECISELY described by St Thomas More in his classic "Utopia". Ergo --corporations are better described as being 'legalized conspiracies' than as 'real people'.

Words fail to describe the depths of lies, propaganda and sophistry indulged by the likes of A. Scalia who --laughingly --believes himself to be 'too smart for the court'!

Most advocates of 'corporate personhood' indulge false analogies because 'false' analogies may be their last redoubt. Clearly --real persons are not so easily defined or summed up having attributes of consciousness and volition that may never be duplicated in unimaginably large super-computers let alone a mere scrap of papers with a seal on it. Simply, 'personhood' cannot be duplicated artificially and most certainly is not duplicated in mere 'legal abstractions' of any kind.

I deny many right-leaning assertions that "modern societies recognise the legal existence as persons of companies or corporations"! If what is said in defense of corporate personhood were true, TRADE UNIONS would, may and should claim 'personhood'. Should they do so, GOP hypocrites would scream bloody murder, foul, no fair!

By simply refusing to tolerate such an outcome, the GOP will have demonstrated its hypocrisy, its disingenuous assertion that corporations are people. Alas --the GOP has historically sought to have it several ways but right.

In the meantime, I urge those who make cars for a living --ORGANIZE AND INCORPORATE!

I urge those who make steel for a living --ORGANIZE AND INCORPORATE!

I urge those who work in any way with respect to the production of oil and/or petroleum related/derived products --ORGANIZE AND INCORPORATE!

In that way, you are guaranteed that you will be treated like REAL PERSONS while, previously, actually BEING a real person would have guaranteed your enslavement to MOLOCH.

ORGANIZE!!!

How 'Indefinite Detention' Has Made of the U.S. a 'Police State'

It was in January, 2002 that the UN Committee Against Torture condemned the treatment of prisoners held at Abu Ghraib by noting that 'indefinite detention' was a violation of the UN Convention against torture! But even worse for U.S. Citizens is the threat that is likewise posed against citizens of the United States. In short, if the government or the President should merely 'deem' you to be a terrorist, you can be dropped into a hole and never seen or heard from again! This continues to be a threat to all Americans of every stripe and income bracket, of every political persuasion left or right should it run afoul of 'powers that be'! The word for this is: tyranny!

The detention sections of the NDAA affirm "...the authority of the President under the AUMF, a joint resolution passed in the immediate aftermath of the September 11, 2001 attacks, includes the power to detain any person "...who was part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners". Anyone so targeted may be held indefinitely "without trial, until the end of the hostilities authorized by the [AUMF]". Of course, there is no 'end of hostilities' in an Orwellian perpetual war.

The Sixth Amendment is violated when U.S. Citizens are alllowed to be detained (locked up) indefinitely at any place in the U.S. or abroad if you are merely 'deemed' to be a terrorist! 'Probable cause' is no longer required; you may be locked up if you look funny or Arab! You may be locked up if you are merely 'deemed' to be a terrorist! There is no 'burden of proof' nor is there any requirement that the government produce 'probable cause' that you have committed a crime of any sort! American citizens may be stripped of all rights if he/she is but 'declared' or 'deemed' to be a 'terrorist', however baseless that declaration may be! Those unfortunate targets of this dictatorial, draconian, tyrannical, anti-democratic measure are subject to being snatched, dropped into an Abu Ghraib type hell-hole or --worse --a Texas gulag and never seen or heard from again!

This is a violation of the Fourth Amendment which reads:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
These measures are all gross and egregious violations of the 14th amendment prohibiting the federal government, the various states and local governments from depriving persons of life, liberty, or property in violation of DUE PROCESS OF LAW, established previously in the 4th Amendment!

This clause makes 'protections' stated clearly and unambiguously in the Bill of Rights applicable to the states. In other words, even states are subject to the SUPREME LAW OF THE LAND --the Constitution! These draconian measures are not merely illegal but treasonous and those supporting them are traitors to the U.S. Constitution, the Bill of Rights and to the people of these United States which are 'sovereign' whether the polticians and lobbyists in Washington recognize that fact or not!

Moreover --I DENY that either President nor Congress nor statutes signed by the President may NULLIFY the above principles of Constitutional law as articulated in the Fourth and Fourteenth Amendments!

If 'Corporations' are 'people', then Labor Should Become a 'Person'

If corporations are people so too are UNIONS! But --should UNIONS assert 'personhood', corporations (which don't like unions in ANY case) would scream bloody murder being comprised as they are of liars, psychopaths and hypocrites who cannot be held to their own 'standards'!

I have urged unions to INCORPORATE! What's to prevent them from fighting fire with fire? Nothing!!! And in this case SCOTUS would have no choice to but to support them having already said that any corporation that they may form is 'A' person.

I suggest that ALL OF THE UNIONS form a SUPER SUPER CORPORATION!

It should strike terror into the hearts of the crooks, liars, hypocrites and robber barons which now makes up the so-called 'corporate community' so dear to the hearts of crooked justices like Clarence Thomas.
THE NATION'S LARGEST UNIONS could --in fact --INCORPORATE and, in one stroke, strike fear and trembling into the hearts of so-called 'corporate AmeriKa':

I would urge this SUPER UNION, INC to sell stock! Few corporations could be so large so quickly. Should this stock sell publicly, this SUPER-UNION, INC could be a major player literally overnight. With that kind of clout, UNIONS could have their own lobbyists on K-Street!

Congress would --to say the least --pay attention and, one hopes, get a clue! Such a powerful 'corporation' could, at the same time, hire an army of lobbyists to lobby for the REPEAL of 'Citizens-United' which congress could easily do by merely, re-defining the word 'corporation'.

The Fascist Coup Called 'Corporate Person-hood'

I was asked to explain why a group of individuals should not have the same freedom of action as a singular individual. And I was told so magnanimously to "...feel free to reference any philosophy journal you wish in your response." My response was to ask WHY and HOW a group --which must act 'collectively' -- acquired what even scientists have called a 'conscience'? I asked for an explanation: how may any "group" and especially a corporation exercise a conscience'?

In fact, no collective, no corporation, no club can --as a collective --exercise 'conscience'. A group --were it a person --would be defined by its inability to act upon conscience, to 'feel' obliged to act in ways that are consistent with an ethical position, a morality, or a secular ethic derived from philosophy or logic. As a result of this hypothetical, I have come to suspect that the very purpose of both corporations and the 'movement' to make persons of them is twofold: 1) to raise huge amounts of cash and 2) to allow them to act FREE of moral restraints --restraints that 'real' persons often trace to 'conscience'!

Groups are not individuals by definition! Groups may act upon a consensus! An individual because he/she is an individual is held accountable for his/her crimes, sins or transgressions against society. That is not the case with groups of any sort nor is it the case with 'corporations'. It was the purpose of Citizens-United to put corporations above all that while granting them 'privileges' --privileges that 'real' persons will never enjoy.

One must not mistake a collective of any sort with the individuals who comprise it. A covey is not a quail; a choir is not 'a' soloist; a single violinist is not an orchestra. Nor can one mistake the sound of a choir with that of an individual soloist. Likewise, a 'pride' can never be mistaken for a single lion nor vice versa. An ant colony is not 'an' ant!

Corporate personhood is a hoax if not a bald-faced lie! And, it has been my experience, that no good has ever come as a result of a lie or the embrace of one. Thus --we come to the reasons that the hoax of 'corporate personhood' was handed down by an increasingly crooked and incompetent court. Corporations have, in fact, used their access to wealth to influence political campaigns in ways that individuals could never do! I speak from experience, having consulted several political campaigns in one of the nation's largest cities.

As an individual, I pay my bills! I don't have anything left over with which to influence politicians of any persuasion ---even Libertarians. But what if I were a large corporation with deep-pockets and even deeper connections to the Republican party? As a corporation I could write off my contributions and get a whopping tax break. The scheme is very nearly perfect but for the fact that corporations --not being persons --could be challenged. The corporate support of a political candidate could not be construed to be 'free speech'. But --never fear --the high court, now dominated by GOP appointees fixed all that!

Corporate contributions are now smiled upon. Corporations may now BUY politicians and perhaps the election itself! That is motivation behind Citizens-United. Being "people" can bankroll politicians in any way they wish. They are no longer constrained. We should not be surprised when corporations attempt and purchase elections outright. The word for this is fascism.

I am reminded of A. Hitler's infamous meeting with Krupp, Thyssen, I.G. Farben (the makers of Xyklon B). Hitler literally auctioned off the Third Reich and offered his services as Fuhrer in residence! Corporate personhood is fascism/nazism given a K-street make-over! But the end result is the same: corporations now have a great light to buy the Rei...uh... the republic! And the 'republic' is given a green light to grant whopping contracts to its corporate sponsors. The government has become a soap-box derby.

The term 'artificial person' is an oxymoron but the GOP would like to have it both ways. With Citizens-United, the GOP could have it both ways: the granting of the rights of individual persons to corporations who retained their ability to raise absurd amounts of cash. 'Real persons' are, by definition, real! Now, however, the corporate right-wing' (fascists) expect us to believe that a 'corporation-cum-person' can be both REAL and --at the same time --artificial --For the purposes of raising cash. Real persons cannot do that. But corporations can and Citizens-United was the right wing solution.

Corporations were at one time only formed in the public interest (build a bridge) and dissolved when the reason for their incorporation was finished. This was a legal protection required to get the job done. But, in any case, it does not make a 'legal abstraction' a 'person'! Fact is --people are biological. A corporation is a legal abstraction, the behavior of which is described in a set bylaws filed with a Sec of State --usually Delaware.

A corporation is better described as a 'contract' outlining the parameters of taxation, commerce, bylaw et al! But CONTRACTS are NOT people either. But there is absolutely nothing that can create people our of mere 'legal abstraction'.

Sir/St Thomas More --arguably the most brilliant confidant of King Henry VIII --most certainly did not believe 'corporations' were 'persons'. More believed, rather, that they were 'conspiracies' and 'conspiracies of crooked rich men' to boot:

"I can perceive nothing but a certain conspiracy of rich men procuring their own commodities under the name and title of the commonwealth.They invent and devise all means and crafts, first how to keep safely, without fear of losing, that they have unjustly gathered together, and next how to hire and abuse the work and labour of the poor for as little money as may be. These devices, when the rich men have decreed to be kept and observed for the commonwealth’s sake, that is to say for the wealth also of the poor people, then they be made laws.But these most wicked and vicious men, when they have by their insatiable covetousness divided among themselves all those things, which would have sufficed all men, yet how far be they from the wealth and felicity of the Utopian commonwealth? A hurd is not a cow! A covey is not a quail! An ant is not a colony! A stamp collection is not a stamp nor is a flock a sheep.

So there, Mitt Romney! Read and learn. You are --despite having sold your soul to the GOP --a person! But as real persons are often intelligent and because real persons have a vote (one person, one vote) you will --with any luck --never assume to the high office to which you aspire.

Support the Proposed Amendment that Would ABOLISH 'Corporate Personhood'

I fully support a movement to enact a 28th amendment to the U.S. Constitution that rejects and will undo the recent SCOTUS decision 'creating people' of 'legal abstractions', i.e, corporations. The idea that corporations are people is insidious, seditious; it endangers American Democracy. While 'real people' are held to the letter of the law and often imprisoned for wrong doing, corporations, as 'persons; will be, in practice, 'above the laws'.

In fact, these newly created 'people' i.e, corporations will be (if not already) placed'above the laws' that apply to mere folk! As has been said:
"I will believe that corporations are persons when Texas EXECUTES one of them!
A proposed amendment would reverse the decision of the high court with respect to Citizens United v. Federal Election Commission. In a 5-to-4 vote, SCOTUS 'created' real people of mere corporations declaring that corporations have, among every Constitutional right, a right of 'free speech' under the First Amendment. It was declared that the government may not 'impose restrictions' on the political speech that corporations may indulge. But, not being persons in fact, corporations have no such right! That is a right our founders believed were inherent rights of people, REAL people!

As a result of this pernicious decision, corporations and other special interest groups are now given license to spend "unlimited amounts of money on elections." They may 'buy' an election openly whereas, in the past, it was necessary to hide the evil deed from public scrunity! A 'real' person cannot do this! Therefore, 'corporate personhood' is, on its face, a violation of the Fourth Amendment!

The decision is a green light to corporations: buy and/or support any candidate with as much money as you want to spend! The decision could not have been a bigger afront to Democracy, i.e, government of the people. Free speech is a right of people as affirmed by our founders. That corporations may now claim that right is simply fascism. It makes of our nation a 'fascist' state ---pure and simple!

The ORIGIN of 'corporate personhood' is found in an informal note from a CLERK: "The defendant Corporations are persons within the intent of the clause in section 1 of the Fourteenth Amendment to the Constitution of the United States, which forbids a State to deny to any person within its jurisdiction the equal protection of the laws." To apply this to 'corporations' requires that one must first assume that the entity is a 'person'! That is called a 'circulus en probando' fallacy. In the vernacular, it's 'backward thinking'; it assumes facts not in evidence. It is a conclusion cited to support a premise.

And --no, Mitt --corporations are NOT people and you, sir, are NOT my friend!

The Equal Protection Clause, part of the Fourteenth Amendment to the United States Constitution, provides that "no state shall ... deny to any person within its jurisdiction the equal protection of the laws."[1] Prior to this mere clerk's mere note, NO ONE had believed that the 14th amendment applied to anyone but real people. Nor does it now! Scalia's court blew it again! If Scalia had a last remaining vestige of conscience, he would confess that he:
  • BLEW IT;
  • ADMIT that he is a bought and paid for tool;
  • RESIGN!

I suspect that the idea of 'corporate personhood' may have its origins in a misunderstanding, a mis-read of Hobbes'. But the Hobbes Leviathan refers to the 'state' --not to businesses that may be chartered in any way whatsoever by a state. In any case, not even the 'state' Leviathan is considered by Hobbes to have been a single person but, rather, the abstract sovereignty invested in the state by the people as a collective --NOT as a single entity as is the case with personhood. Nor have I found anything in Hobbes that asserts that the 'state' has the power to make 'people' of abstractions whose only raison d'etre is the making of money.

A herd is not a cow! A covey is not a quail. A stamp collection is not a stamp nor is a flock a single sheep. An ant is not a colony, but more to the point, a colony is NOT an ant.

Mitt is Either Wrong or Lying; Corporations are NOT People

Mitt Romney seemed very precise: "Of course, corporations are people, my friend!" His argument is as follows: corporations were made up of people; ergo: they ARE persons themselves.

That's fallacious of course! It's also a very bad re-write of Thomas Hobbes who described a Leviathan --a 'state' comprised of the people in it. But not even Hobbes would have dared to say that the 'state' IS a person! Being 'comprised' of people is not the same thing as being a 'being' a person.

As a person, I am made up of millions of cells, each of which replicate my DNA to some degree. But to say that EACH cell IS "ME" is absurd. What if I should prick my finger and I lose some blood? Have several hundred thousand 'people' died? Of course not!

Romney seemed to be arguing that because money that "...gets into people's pockets" does so by way of companies, companies are therefore 'people'! Again --his argument is not only fallacious but non-sensical! That workers are paid by corporations does not make people of corporations.

What about those 'people' not employed by the corporations about which Romeny spoke? Are we to believe that they are NOT people? In Romney's view, one must work or be indentured to a 'corporation' in order to be a person! That's absurd on its face. Clearly:

  • Romney has never truly understood the issue and may be incapable of understanding it
  • He is ignorant of the implications
  • He needs to take remedial courses in elementary logic and biology
  • Corporations are NOT and will never be 'people'
Let's consider Mitt's analogy in this way: if it were true that every cell in my body is a 'person', anyone cutting off my finger is, at least, guilty of assault and battery and possibly the cold-blooded murder of millions of little, micropscopic 'ME's". 

Being a 'person' occurs by virtue of being born of two members of the species: homo sapien! That is not the case with a corporation, any corporation, a corporation of any type! A corporation is, by definition, a charter, filed with a Secretary of State (most often Delaware); the charter outlines the corporate structure, lists the major officers and describes the 'type' of 'incorporation in legal terms. It is a NOT a person but simply a contract listing the major stockholders, summarizing the management and delegating various responsibilities. Certain accounting conventions follow but, certainly, no procedure has the God-like power to create 'persons' with a ledger book! No such combination of debits and credits has ever breathed life into inanimate objects and, by doing so, make 'people' of them!

When a corporation is given birth to by a woman as a result of her doing what human beings (persons) have done for thousands of years, then I might concur that corporations are persons. That will happn when pigs fly. And pigs WILL fly when I vote for a moron like Mitt Romney.

In the meantime, I suggest Mitt...

  • go back to school
  • take a biology course
  • take two semesters of philosophy
  • take two semesters of symbolic logic and one INTRO to the "Philosophy of Logical Analysis".
And ---corporations are NOT and never will be "people'!

An American Gulag

A famous Texas scandal spawned a legend and a movie: "The Best Little Whorehouse in Texas", starring Burt Reynolds and Dolly Parton. Many, not familiar with Texas scandals, probably thought it referred to the state legislature where various "favors" and "special considerations" are sold to special interests and various lobbys. But --it's not a whorehouse; it's just a circle jerk.

Of late, Texas has taken political prostitution to levels not seen since A. Hitler pimped his "Third Reich" to corporate 'johns' --I.G. Farben, Thyssen, Krupp! All would get big, juicy, sexy government contracts if they but joined his crazy, evil scheme to enslave the world and exterminate jews, gypsies and anyone else not liked by Hitler, his cult of Nazis, his hand-picked perverts, whack-jobs, and a panoply of marginal and otherwise ineffective types, in fact, those who would be failures in a normal world. And those are the Nazis!! The GOP may be worse.

The scam is often repeated in various ways by the American GOP but the Texas model, cooked up by Herrs Bush and Perry, may have outdone Hitler's blunt approach but, in the end, it's all Nazism. Hitler met 'industrialists' Thyssen, Krupp and several representatives of I.G. Farben --the makers of Zyklon 'B'. The meeting is described in some detail by William Shirer in 'The Rise and Fall of the Third Reich'.
Goebbels was jubilant. "Now it will be easy," he wrote in his diary on February 3, "to carry on the fight, for we can call on all the resources of the State. Radio and press are at our disposal. We shall stage a masterpiece of propaganda. And this time, naturally, there is no lack of money."(2)

The big businessmen, pleased with the new government that was going to put the organized workers in their place and leave management to run its business as it wished, were asked to cough up. This they agreed to do at a meeting on February 20 at Goering's Reichstag President's Palace, at which Dr. Schacht acted as host and Goering and Hitler laid down the line to a couple of dozen of Germany's leading magnates, including Krupp von Bohlen, who had become an enthusiastic Nazi overnight, Bosch and Schnitzler of I. G. Farben, and Voegler, head of the United Steel Works. The record of this secret meeting has been preserved.

Hitler began a long speech with a sop to the industrialists. "Private enterprise," he said, "cannot be maintained in the age of democracy; it is conceivable only if the people have a sound idea of authority and personality . . . All the worldly goods we possess we owe to the struggle of the chosen ...We must not forget that all the benefits of culture must be introduced more or less with an iron fist." He promised the businessmen that he would "eliminate" the Marxists and restore the Wehrmacht (the latter was of special interest to such industries as Krupp, United Steel and I. G. Farben, which stood to gain the most from rearmament). "Now we stand before the last election," Hitler concluded, and he promised his listeners that "regardless of the outcome, there will be no retreat." If he did not win, he would stay in power "by other means . . . with other weapons." Goering, talking more to the immediate point, stressed the necessity of "financial sacrifices" which "surely would be much easier for industry to bear if it realized that the election of March fifth will surely be the last one for the next ten years, probably even for the next hundred years."

All this was made clear enough to the assembled industrialists and they responded with enthusiasm to the promise of the end of the infernal elections, of democracy and disarmament. Krupp, the munitions king, who, according to Thyssen, had urged Hindenburg on January 29 not to appoint Hitler, jumped up and expressed to the Chancellor the "gratitude" of the businessmen "for having given us such a clear picture." Dr. Schacht then passed the hat. "I collected three million marks," he recalled at Nuremberg.(3)

There are other, corroborating sources for this meeting.
Hitler did not intend to share his power with coalition partners. After the dissolution of the Reichstag, he hoped to win an absolute majority for the NSDAP with a massive election campaign. To finance the electoral battle, he sought support from Germany’s leading industrialists. In a meeting held on February 20, 1933, Hitler and Hermann Göring (1893-1946) explained the benefits that industry leaders would derive from an NSDAP victory: political stability, the complete elimination of the Communist threat and, not least, a lucrative rearmament policy.

Among those present at the meeting was George von Schnitzler, a board member of I.G. Farben, then the world’s largest chemical conglomerate. (I.G. Farben would eventually go on to produce the Zyklon B gas used in Nazi death camps). In the following affidavit, given in English on November 10, 1945, Schnitzler describes the purpose of the meeting and provides the names of others in attendance that day.

The TX gulag system differs very little from concentration camps. To be expected, they look modern from the outside. But, like Hitler's string of concentration and death camps, they are the work of 'private enterprise' contracted by 'government'; it is private enterprise which benefits from the Faustian deals that created them. Reduced to its essence, Hitler's 'Nazi' scheme systematically murdered millions and just as systematically reduced as many to slavery amid unimaginably horrible conditions.

A 'party' is what it does! If the basics of this 'privatization scheme' are repeated by Texas Republicans with similar/same results, then in what way does it differ from 'fascism' or 'corporatism' or "Nazism'? In Texas, politicians have been known to say: "if it walks like a duck, quacks like a duck and swims like a duck, it's a duck!" Indeed! One is what what does! A political party is what it does! The GOP has repeated the Hitler model in Texas with respect to its gulag of prisons! Am I to call the Texas GOP 'boy scouts' because they are not in Germany? Of course not! I will call them what they are and what they are, in fact and deed, are fascists!

The Texas GOP Learned From Hitler's Mistakes

The Bush family has worked to establish the same or similar model in Texas. The fruition is seen in the Texas gulag of corporate-owned prisons. The roots of this horrific outcome may be traced to Nixon-Bush overtures to China. Bush Sr's efforts to set it all up are too often forgotten by writers focused upon Nixon's largely ceremonial trip to the Forbidden City. Recall that Bush SR was ambassador to China under Nixon, that it was Nixon that took the U.S. off the gold standard; but it was most certainly Bush Sr who cut the deals in advance of Nixon's largely ceremonial trip.

It was, therefore, Bush Sr who sold us out to China. Like a bad penny, a Bush always seems to turn up when one researches China, oil, the U.S. imbalance of trade with China, oil wars, and other 'rotten' things.

That Texas would eventually play a role in the grand scheme of things was inevitable. It was an oil producing state; later, an oil refining state. And Texas has a history of often rampant lawlessness. Now –my great uncle, Lawson 'Loss' Hart, was on the right side of the law. As a federal marshal, he tracked down, outdrew, shot and killed the infamous outlaw --Bill Dalton of the notorious Dalton gang. We could use a few more 'Harts' who might, likewise, track down the lawless Bushes, the crooked gang called GOP!

Bush SR's choice of Houston as his permanent residence was unfortunate for Houston. I recall speaking with Houston Mayor Fred Hofheinz (middle 70s)! The occasion of that specific conversation was a 'smear job' that was making the rounds, a 'smear job' that might as well have had 'G O P' stamped on it with a copyright date. Hofheinz said to me: "There is something rotten in Houston!" It was as much his tone and demeanor as the sentence itself that sent chills down one's spine.

The mayor's comments came during an organized but shadowy campaign of rumor and villification against him. The rumor surfaced immediately following an infamous 'reception' for the Sr Bush at the venerable old Rice Hotel in downtown Houston. I believe that it was already envisioned, decided, that the Senior Bush would --one day --become President, and that Jr (Shrub) would, likewise, occupy the White House one day. Thus --in two generations the GOP would effect what Sr himself referred to as a 'new world order'.

The resulting fascist prison model that is now in place and operating in Texas is proof that they have not yet failed in their mission. As Hitler made promises to Thyssen, Krupp, Farben et al, one wonders: did Bush and Perry promise to subvert Texas education, in fact, reducing the state to dead last in high school graduations? Is this the crux of the deal? Essentially --we trash education and thus ensure the prisons a full house!

I thought it ironic that the man most responsible for the GOP infestations in Texas --Tom DeLay --was, himself, a roach exterminator by trade. GOP strong-holds with which I am most familiar were/are GOP infestations in Brazoria county and Fort Bend County. It was in Fort Bend County that Tom DeLay built up a base that would eventually allow him to gerrymander the state, making Texas safe for fascism.

Brazoria County got a new Republican High Sheriff who set out on a course of absolutely zero tolerance. So many were arrested he had to build his own little mini prison in the county. I am surprised that he was not awarded a title: 'Duke'.

The GOP/right wing inclined would rather build a prison than prevent the crimes that fill it. Why? That's easy! There is less easy money to be made locking folk up when crime rates are in decline! For the same reason, the right wing would rather not "waste tax payer money" to educate a child. Better to let him take to the streets, rob a convenience store, perhaps shoot someone, get arrested, sentenced and locked up in a corporate prison where the GOP's corporate/wealthy base and support could make an easy buck by warehousing him.

But the Texas GOP has done Scrooge one better: they are making a profit off both their deaths and incarceration.

WHERE is the will to win? When the right wing has succeeded in destroying civilized society if not the world, the left will have failed to save it!

The Rise of Fascism in Bush-Perry Texas

Recently --Texas Gov Rick Perry's boisterous audience of schizoid GOP idiots were caught waving US flags: SECEDE! Perhaps, because of what the GOP has made of it, Texas should secede. By presiding over the deterioration of public education in Texas, the Bush/Perry GOP has created a fascist model in which the profits of huge, right-wing inclined corporations rise as TX educational standards decline; a model in which illiteracy rises concurrently with corporate profits; a model in which the living conditions of millions deteriorate as the lifestyles of a dwindling few grow opulent beyond the ability of even oil barons to imagine.

Texas is about 50 years behind the US. As Bush-Perry neglected education, crime rates rose, most noticeably --murder! Drop-outs account for most, if not all, increases in violent crimes. Minorities --primarily black and Hispanic --are meanwhile disproportionately represented in the Texas gulag system but under represented in the State legislature, the various city councils, and the state judicial system.

Texas was once a Great State and, as a native Texan, I mourn its passing!

Declines in education and jobs are of no concern to the current Governor --Rick Perry, called Governor Good Hair by Molly Ivins, a real Texan, a patriot and brilliant writer. During the Bushy - Hair era, Texas became a gulag state by beating out Mississippi for dead last in high school graduations. A matter of considerable concern among intelligent, thoughtful people but for the axis of Bush-Perry it means more fodder for the corporate owned and run state prison system. The word for this is fascism! There is, in Texas, a corporate gulag of GOP making. One fears that the Texas model will be replicated across America:
  1. subvert public education
  2. exploit the resulting rise in crime to elect more GOP candidates
  3. lock up the victims in corporate-owned prison hell-holes.
That is how Texas became the lab study, the 'fascist model' upon which a fascist state is built. This model is not new. Hitler tried it with concentration camps. The primary corporate beneficiaries were I.G. Farben and Thyssen/Krupp.

These basic fascist principles have inspired movies --good, bad, and ugly. The 'bad' summons up memories of a horrible movie: Judge Dredd, a fascist 'wet dream' in which so-called 'judges', having murdered 'due process of law' could pass sentences on the spot! Fascists, red necks, Bush, Perry were most surely inspired by a single line summing up so many GOP aspirations: “The justice system works swiftly in the future now that they've abolished all lawyers.”

The rise of Fascist-Goppism in Texas was signaled by the constant anti-trial lawyer drumbeat. Soon --trial lawyers will be out of a job and no one will be allowed to present a defense. No problem --Judge Dredd and Gov Perry will just fill up those corporate hell-holes with fresh meat!

Slavery is back! Perhaps it never left! Every fascist dictatorship is preceded with cries of : kill all the lawyers! Depriving them of a profession, a livlihood may be slower but just as effective.
Crimes rates --rising, falling, stagnate --never justify the death penalty. In fact, crime rates invariably increase in death penalty states. States without the death penalty have consistently lower murder rates.

The GOP in Texas might prefer you think they are stupid. Otherwise, you might conclude that because these facts may be easily obtained and verified that their heinous policies were chosen --not out of GOP incompetence --but deliberately for the purpose of filling up the prisons, thus enriching the corporations which own and run the prisons.

The death penalty is medieval, barbaric and ineffective. Throughout history, the death penalty has failed to deter crimes of any sort. There is, therefore, no rationale for the state murder of anyone accused of any crime. Increasingly fewer cases are 'proven' beyond a 'shadow of a doubt'. A disproportionate number are arrested for the crimes of being black and/or poor.

States Without the Death Penalty Have Better Records on Homicide Rates
A new survey by the New York Times found that states without the death penalty have lower homicide rates than states with the death penalty. The Times reports that ten of the twelve states without the death penalty have homicide rates below the national average, whereas half of the states with the death penalty have homicide rates above. During the last 20 years, the homicide rate in states with the death penalty has been 48% - 101% higher than in states without the death penalty. "I think Michigan made a wise decision 150 years ago," said the state's governor, John Engler, a Republican, referring to the state's abolition of the death penalty in 1846. "We're pretty proud of the fact that we don't have the death penalty."

Texas, notably, has not occupied a position of prominence with regard to petroleum production since it was discovered that bombing Iraq and killing civilians there was much, much cheaper than is the secondary recovery of oil. Why spend millions exploring for oil when you can just steal fields that are already productive?  The cost of bombing the crap out of the oil's rightful owners?? Hell --the taxpayer is stuck with that tab!

Because of rapacious oil development, the neglect of education and the hubristic disregard for human rights and environment, so-called 'free enterprise' has robbed millions of children of a decent education and as many poor of justice in a state ruled by goddamned liars, elites and their ass kissers: the GOP!

Fascism --now dominating the political and cultural life of Texas --spawns crime and creates the conditions in which it is nurtured and thrives and, worse, benefits the GOP and its corporate sponsors.
Still, most people are now ashamed to admit that punishment is based on vengeance and, for that reason, various excuses and apologies have been offered for the cruelty that goes with it. Some of the more humane, or “squeamish,” who still believe in punishment, contend that the object of this infliction is the reformation of the victim. This, of course, cannot be urged of the death penalty or even punishment for life, or for very long-term sentences. In these cases there is neither inducement to reform nor any object in the reformation. No matter how thorough the reform, the prisoner never goes back to society, or he returns after there is no longer a chance for him to be of use to the world or to enjoy life.

If there is a real and widespread desire among Texans to secede, then, by all means, secede. But in fact, I believe secession talk is just another right wing smokescreen with which it exploits its base and deceives otherwise good citizens of Texas!
Power may corrupt, and absolute power may corrupt absolutely, but in the comics Judge Dredd is basically Dirty Harry on Overdrive, an incorruptible lawman obsessed with The Law and Justice. The official plot synopsis of the 1995 movie swallows the official line too: “In the Third Millennium a powerful and efficient hybrid of the police and judicial system has given birth to group of new guardians of the law with the power to dispense instant justice and punishment. These judges are law enforcer, jury and executioner. One of these judges, Judge Joseph Dredd is a living legend - six feet of armored justice with no outside interests besides his devotion to enforcing the law.” Why anyone would however want to make a sequel or (bullshit Hollywood jargon coming up) “re-imagining” of Judge Dredd is a bit of a mystery. The original film disappointed at the box office and made a mere $113 million world-wide. Audiences who didn’t know the character beforehand were baffled. “Considering that the movie was adapted from comic books, the least we should expect is a juicy battle between good and evil,” Anthony Lane wrote in The New Yorker, “but the conflict is, in fact, a matter of fine distinctions between shades of Fascism.”

The Right Wing Renews its Ongoing War on a Fair and Free Media

The U.S. right wing will not be happy until every American is reduced to a mere 'consuming' machine, a unit, into which is fed the most absurd lies, the most outrageous right-wing rewrites of history, the most transparent pre-texts for war, aggression, oil theft, ongoing deprivations of civil liberties. As wealth is transferred upward to what is now a ruling elite of just one percent of the entire population, we are expected to concede our last redoubt: 'our' media!

The latest outrage is the more recent reprise of the right wing's ongoing attack on what had been the people's airwaves, the people's media, the people's right to know and its implicit corollary: the people's right to be told the truth!

Krasnow's conclusion is absurd! What value has the public derived from being lied to and/or brainwashed? If his only concern is how 'broadcasters' may return a profit then consider the more reasonable alternative to the 'theft' of publicly owned airwaves. Let the corporations rent the airwaves from the 'people' whose ownership of the public airwaves was recognized by the Communications Act of 1934! Even better --allow a publicly owned corporation to manage and utilize the 'airwaves" for the benefit of millions that are reduced to mere demographic targets today!

Where is the precedent, the principle that says the public at large is responsible for ensuring that big corporations make big money? Where --in the history of Europe and the U.S. --is there an established principle that the people are responsible for ensuring that a corporation be successful? Where is the principle that awards assets to a private enterprises because 'profits' are not returned to someone should the people own them? There is no such principle! But given enough time Antonin Scalia is sure to pull something just as absurd out of his ass!

To expect the public to finance the very lies that are served up to them is absurd if not criminal! KRASNOW'S reasoning is fallacious, a right-wing inspired rationalization, an ex post facto excuse to let huge corporations reap huge profits by lying to us, brainwashing us, and otherwise kissing up to the right wing of which they are a part! Such a corporation could not possibly do a worse job than have the likes of FOX et al. As evidence --I give you Rush Limbaugh, Billo, Hannity, the entire FOX network and every screaming Limbaugh wannabe in the nation! It is time these charlatans and posers be denied the 'privilege' of yelling 'FIRE, FIRE' in a crowded theater(s)!

The full-court press against the people's rights began when Ronald Reagan appointed communications attorney Mark Fowler to head up the Federal Communications Commission. Fowler had served on Ronald Reagan's presidential campaign staff in 1976 and 1980. He became Reagan's hatchet-man. The FCC began to repeal parts of the Fairness Doctrine, announcing in 1985 that the doctrine had hurt the public interest and violated free speech rights guaranteed by the First Amendment." That's nonsense.

Trashing the Fairness Doctrine, in fact, denied 'free speech' to everyone but the ruling elites who can afford the millions of dollars it takes to own and operate a radio station, perhaps the billions required to operate a world-wide network of right wing nuts, fascists, and goofy goons like Billo Really? and Glenn Beck! ? Ask youself: does 'free speech' exist at all when ONLY the likes of Billo and Beck have the 'right' to lie to millions every second that they are on the air? Of course not! You have been reduced to passive vassal. As long as the right wing continues to steal and abuse what had been YOUR airwaves, free speech exists only for the mere 1 percent who can afford to buy a network or even a single radio station!

How GOP Fascism Screwed Texas

When a state or nation fails to live up to its basic obligations to the people, it is in breach of contract. It is the right of the people to rise up and replace --by any means --the illegitimate regime. If that sounds radical, I refer you to the words of James Madison, Thomas Jefferson, John Locke, Jean-Jacques Rousseau and Voltaire! You might also consider the Magna Carta!

What the GOP has in mind for the rest of the nation, it has very nearly accomplished in Texas. Under the criminal and incompetent management of George W. Bush and, later, Rick 'Good Hair' Perry, Texas is reduced to third-world status --an outcome resulting from Bush/Perry neglect and overt contempt for public education.
Our schools are in crises: We [Texas] rank 36th in the nation in high school graduation rates. An estimated 3.8 million Texans do not have a high school diploma. We rank 49th in verbal SAT scores, 47th in literacy and 46th in average math SAT scores.'

But you can rest assured that the private schools in Texas are doing fine. But it is in the public schools that those not born to wealth have any hope of acquiring an education. But the elites would deny you even that!

A detention camp in Taylor Texas that currently holds hundreds of rebuffed asylum seekers who legally entered the country, half of which are children swept up in midnight raids, is a potential prime location for the enforced transfer of American citizens during a time of national emergency.

The privatized Hutto jail, which is also administered by Homeland Security and Immigration and Customs Enforcement (ICE), currently interns political asylum seekers who came to the U.S. on legal visas. Most of them are families including pregnant women and children who have never been accused of any wrongdoing but are forced to endure squalid conditions inside literal concentration camps.

In 2004 the facility was on the verge of being shutdown due to lack of occupancy but new immigration policies, allied to the burgeoning growth of the prison industry and future plans to detain American citizens en masse, have revived the potential scope of the camp, and a new contract to intern 600 individuals was finalized with immigration authorities in December 2005.

The facility is euphemistically called a "Residential Center," yet charges of overcrowding and poor conditions are rife, with an estimated 645 people filling a facility that has only 512 beds.

This is a fascist outcome and as a result, the corporate prison population has exploded. If trends continue, one day, there will most surely be more folk in prison than out. This is a GOP payoff, a 'laundered' pay0ff, to the corporations for their support of the Texas GOP.
The newly instituted leveling system on death row in Texas under which prisoners are classified in one of three categories—supposedly based on their disciplinary record—is nothing but heightened repression.

It masquerades as a means to provide uniform rules and regulations in managing male prisoners sentenced to death. But in truth it is a reactionary response to prisoners’ efforts over the years to organize themselves against cruel and inhuman treatment.

The Endeavor Project, the Lamp of Hope Project, and now Panthers United for Revolutionary Education are just three examples of prisoners’ efforts to protect themselves and resist.

Any time prisoners, and even people on the outside—unions, women, people of color, gays—begin to organize themselves across color lines, the system devises counter-schemes to bring it to a fast and abrupt halt.

The Texas death row leveling system is another of these, out of a huge bag of trickery designed to dominate, subjugate and divide prisoners. It’s no different from when businesses divide workers, colleges divide students, and the ruling class divides the poor masses by establishing lines of antagonism.

Before the leveling system, all death-row prisoners in Texas—except for those classified as work-capable—were already confined to "administrative segregation" status. In other words: lock-down.

As high school graduations per capita declined, crime in Texas, most notably murder, increased. Not surprisingly, the prison population swelled to overflowing. The GOP in Texas has, thus, enriched, the corporate, fascist owners and operators of prisons.

'Are there no prisons?' --Scrooge

These outcomes are not coincidence, not the result of incompetence, not the result of mere GOP idiocy, though many, like the Bush crime family, are idiotic to be sure! No --this is, rather, fascist policy; it is a laundered pay-off to the GOP's corporate 'base'. The corporate-GOP axis makes out like Nazi brass or the likes of I. G. Farben, the makers of Zyklon B. The made a killing. It is only the citizenry which suffers, a citizenry that is increasingly deprived of educational or vocational opportunity so GOP fat cats can continue to feed off the misery of its victims.

The Oil Boom is Over

Texas must learn to make an honest living. Texas must face up to its responsibilities now and to future generations or it will perish. Under the disastrous back-to-back Bush/Perry regimes, Texas is well on its way to economic oblivion.

The results are disastrous:

  • Texas/Bush style provides the residents of Texas with some of the nation's very worst crime and incarceration rates
  • Texas subjects the residents of Texas to deteriorating air quality and wanton ecosystem destruction;
  • Texas can boast of having the nation's very worst murder, crime and incarceration rates!
  • Texas now leads the nation in pollution, crime, and illiteracy --should be studied by any other state wishing to avoid a similar distastrous fate.
As education standards and performance declined with the ascension of George W. Bush to Governor and his equally incompetent successor --Rick Perry --crime rates, primarily murder and armed robbery have increased. Naturally, there is a round up of the usual suspects, i.e, the poor and those caught in the act of being black or brown.

The increase in crime in Texas is the result of GOP policies and the GOP's criminal neglect of education. The crime resulting will prove to be yet another 'growth industry' for the likes of Halliburton/KBR as was the Bushco war against the people of Iraq!
How infuriating has it been, the last five years, watching Halliburton and KBR get away with murder? Murder, poisoning, electrocution, rape, human trafficking, fraud, bribery — their crimes go on and on. But could their decade-long spree may be coming to an end? This year, settlements for old offenses, new exposés and new lawsuits for more recent evil-doings, have resulted in plummeting stock prices, canceled contracts, and a soon-to-be imprisoned former CEO.

The latest blow came last Thursday, in a Texas court, where executives for Halliburton and KBR were described in legal papers as conducting a “reign of terror” and functioning “as criminal enterprises.” Paying bribes, taking kickbacks, concealing gang rapes, and engaging in human trafficking were among the crimes listed on the May 14th complaint brought not by government or human rights lawyers, as you might expect, but by attorneys filing a class action suit for the pension fund of Detroit’s Policemen and Firemen. According to the press release issued by the funds’ attorneys, Grant & Eisenhofer, Halliburton and KBR’s directors enabled “a pervasive environment of misdeed and corruption,” resulting in suits, investigations, fines, penalties, and settlements of over $650 million, which have ravaged the corporations’ reputations, prospects, finances, and in turn the pension fund’s investment.

The Texas suit covers the period both before and after KBR became an independent company, and names the majority of the two companies’ recent and current boards, including such corporate heavyweights as past president and chairman of American Airlines, Robert Crandall. The May 14th press release by attorneys originally listed former Halliburton CEO, Dick Cheney as a defendant (not surprising, since most of the Nigerian bribes occurred under Cheney’s tenure; Cheney also appointed and directly supervised Stanley), but a hastily issued correction stated that Cheney had been listed in error. The complaint identified some of Halliburton’s and KBR’s known “misdeeds” in Iraq, including providing troops with untreated, untested water from the Euphrates and delivering ice to troops in a truck that showed signs of its former use as storage for corpses. The complaint concluded, “The myriad crimes and wrongdoings discussed above simply could not have happened if Defendants were doing their jobs. As officers and directors of the Companies, the Defendants were required to ensure that the Companies’ internal controls were in place, functioning properly, and sufficiently strong to prevent it from committing wrongful or illegal acts.”

The Detroit pension fund suit is one of many recent suits against Halliburton and KBR. In November 2008, Joshua Eller, a civilian employee at Balad Air Force base northeast of Baghdad, cited rotten food, contaminated water and ice, and toxic fumes from open burn pits, as contributors to his ongoing depression, nightmares, and gastrointestinal and dermatological conditions. In March 2009, parents of Staff Sergeant Ryan Maseth sued KBR for wrongful death from electrocution in the shower at his Green Zone base. In April 2009, troops, private employees, and families filed nine lawsuits against KBR for compensation for illness and deaths from exposure to toxic fumes from Iraq and Afghanistan burn pits. The suits, which lawyers will be pursuing as a class-action, seek damages “in an amount sufficient to strip defendants of all of the revenue and profits” involved in managing waste for military bases.”

But the pension fund suit is the first initiated by shareholders, and the stakes are high. Grant and Eisenhofer is a formidable opponent, ranking first among plaintiff firms in funds recovered for shareholder clients. The firm is currently involved in class action suits against Barclays Bank, Countrywide Financial, UBS, Pfizer,and Merck as well as Tremont Holdings Group Inc, a fund charged with feeding $3 billion of client investments to Bernard Madoff Securities.

A Day of Reckoning

With any luck, the whistle may have been blown.
New York - On Monday, Dec. 6, a district court in Texas will be asked – for the first time in that U.S. state's history – to decide whether the death penalty is unconstitutional based on the "disproportionately high risk of wrongful convictions" in Texas.

John Edward Green, Jr., the defendant in Texas v. Green, is charged in the fatal shooting of a 34-year-old Houston woman during a 2008 robbery. He has not yet been convicted, but prosecutors say they would seek the death penalty.

Green's attorneys have filed a pretrial motion in Harris County District Court. Judge Kevin Fine will hear arguments that the death penalty is unconstitutional because it creates an unacceptable risk of executing innocent people

Green's attorneys contend that a number of factors in Texas's legal system increase the risk of innocent people being executed.

According to the defence, these include a lack of safeguards to protect against mistaken eyewitness identification, faulty forensic evidence, incompetent lawyers at the appellate level, failures to guard against false confessions, and a history of racial discrimination in jury selection.

Paul Cates, director of communications for the Innocence Project, told IPS, "The Innocence Project will be participating in the hearing specifically to put on evidence about the cases of Claude Jones and Cameron Todd Willingham. Both Jones and Willingham were executed in Texas."

He said, "In the case of Claude Jones, DNA evidence has proven that critical physical evidence (a hair sample) used to place him at the scene of the crime did not belong to Jones. Cameron Todd Willingham was executed even though a prominent arson scientist notified the Governor and the appeals court prior to his execution that the critical testimony of the arson investigator was based on outdated arson science."

The death penalty is cruel and unusual punishment (especially if you happen to be innocent) but, in Texas, its application is clearly discriminatory.
Mississippi and Arkansas have the highest poverty rates in the nation (at 21.9% and 18.8%, respectively), and Florida saw the largest increase in poverty (2.8 percentage points) over the course of the recession, new Census data shows. Poverty was lowest in New Hampshire (8.5%) and Alaska (9.0%), but even in those states at least one in 12 residents lived in poverty.

While the new data from the Census Bureau’s American Community Survey (ACS) are similar to the nationwide data on poverty released earlier this month, the ACS provides a more detailed look at poverty in every state. The result is more evidence of the widespread pain resulting from the Great Recession. In the nation overall, there were 42.9 million people in poverty in 2009. For the average family of four, this means that their combined income for the year was less than $21,954 (the exact threshold varies by family size and number of children). From 2007 to 2009, 47 states and the District of Columbia experienced increases in their poverty rates. The first Map shows poverty rates by state and how they changed throughout the Great Recession, which began in late 2007.

One day, some believe, a ruling elite of just 1 percent of the total U.S. population may decide that a declining profit margin no longer justifies the 'business' of warehousing, torturing or murdering people because just 12 people decided that they did not deserve to live free or live at all!

The 'elites' may be tempted to pull out, to take the money and run, to 'cauterize' the prisons, dump the problem upon an unsuspecting but 'not rich' population. Thus --they will leave behind a dismantled and/or crumbling infrastructure incapable of handling a prison population of some 2.5 million across America. The corporate robber barons will decide that it is no longer worth the bother with either the infrastructure or the accounting of some $190 billion a year --more than the combined costs of wars against Iraq and Afghanistan.

At this point, the corporate psychopaths, having made a living 'killing' and 'warehousing', may decide as did Hitler before them that a 'final solution' is required.
Like in the late 1930’s, the “final solution” will be the mass extermination of prisoners across the U.S.A. And Texas – always at the vanguard of fascism – has already begun. At first by “medical means” with the complicity of the University of Texas Medical Branch (UTMB) in Galveston, now charged with all medical care (or lack thereof) across various TDCJ’s. That is how TDCJ/UTMB murdered courageous “jailhouse lawyer” David R. Ruiz: whose Ruiz v. Estelle lawsuit brought TCCJ under the heel of the Ruiz Court for nearly two decades. UTMB denied Ruiz timely lifesaving cancer treatment, much requested, until it was “too late to treat.” But there are many others: among the growing elderly population and the sick.
